    Update from the DEBTMONSTER! I signed today! Woo hoo!

    Just keeping you guys in the loop. Finally we're getting some progress.

    First was meeting with the attorney.

    Second was coming up with $2500 to pay him and bring bank statements, tax returns, etc.

    Third was going back to him and paying him $500 more since he said I had a lot of debt.

    On the paperwork it's showing over $150,000 in unsecured stuff... plus the houses and cars which I won't be re-affirming.

    I must have signed like 50-80 pieces of paper with these people today for this bankruptcy paperwork. The printer just kept cranking stuff out while I was there. This would be no fun doing this Pro Se! I'm glad I paid these guys to figure all of this stuff out. It would be too frustrating to do on my own.

    Anyway... all of the paperwork is signed. The attorney will be reviewing everything that the paralegals did to cross all of the T's and dot all of the I's.

    Hopefully by this Friday they will have me filed with the court and next week I should have a case number!!! This will be AWESOME!!

    I told you about my situation last year and I DID NOT want to file bankruptcy. You guys all ragged on me hard for wanting to keep a car with a $700+/mo. car payment.

    Now I'm giving BOTH cars back along with our house. We're not fighting to keep anything. Let the creditors COME AND GET IT!

    Anyway... as I was signing the paperwork, I was talking to the paralegal and telling her that we needed to keep the cars until next year. Just like you guys all told me... she said the same thing... that I will have to give the cars back right after the case is discharged.

    I contacted the attorney again when I got home via email and told him that I needed these vehicles to last me until at least January so I have time to save up for a new car. He wrote to me saying that I could keep the cars until then, although the paralegal's response was conflicting and matching what you guys told me.

    So I guess in 90 days I will find out what I have to do. I'll either have to give back both cars, or I will ride it out until I can get big bucks put away for a fat down payment on a new Yaris, smart car, Mazda, Corolla, or what have you.

      Yeah!! Congrats on getting the ball rolling...

      Did you inform your attorney what HIS paralegal told you...car goes back after discharge?!?
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

          Here's a pic of the lady doing the paperwork during our filing. She did the paperwork for us and then as we were signing it, she was doing paperwork for the next people right after us! Wow... these people are efficient and waste no time!

          They had a lot of people in the waiting room getting ready to get their papers signed after they paid in full.

            No. I did not want to rock the boat between the employees and the attorney. Maybe that was typical for many people. If you don't ask to keep the car, then he won't volunteer to do it. I asked him specifically about it, so he's doing it sort of as an easy favor.

            If he can't do it, then so be it. Then I will have to get what I can to buy a used car for cash or see if a car dealer will accept what I can have saved up by then. It will just be 10x easier to wait until January. That gives me August, September, October, November, December and January's income months to put away money. And if he can go even further than January, then I can start putting money away for car #2 for my wife.

            If it, it's not the of the world. It's just a "nice to have" kind of thing if he can actually do it.

              Just curious, did you happen to ask your attorney on what are the chances the UST will be getting involved since you have $150,000 in unsecured stuff?

              As for vehicles...how about a Nissan Versa@ $9995?

                I didn't talk to the attorney. What is the big deal about the UST being involved? Why would they if I am not planning to keep anything? I will have to wait until I get to that bridge until I cross it. Nothing is really in my control now. I feel like I am driving a car down the road and I have no arms.

                There's no way you can get a Versa for $9995.

                The 2009 1.8S automatic is $14,200 dealer invoice after a $1250 rebate. That car has problems.

                Plus to me, that car looks ugly. I like a Yaris better, but the 2009 Yaris absolutely SUCKS in a head on crash. I prefer a smart car over both. Smart cars aren't much more than the Versa and offer stability control, ABS brakes, power windows, power locks, cool looking interior.



                That interior looks way cooler than any boring econobox car.

                  I love the paralegal we dealt with, actually will miss her once this is over. I know that is probably weird, but she made this process so much better for me. I could call her anytime, she actually is so smart and going to school to become an attorney, which I told her she would make a great attorney, she really knows the BK laws. Our attorney told us she is alot of the reason people come to him! LOL

                  Anyway congrats and here's to your BK going smoothly and quickly!! And to a brand new start for alot of us in '10!

                    Thanks. That picture was taken today in Miami... far from Indiana.

                    I don't even know her name. That place must have had at least 8 to 10 people working there. I would love to say, "This guy is good!" but the bankruptcy isn't over yet. What if I go through all of this trouble and then like they said, the UST gets involved and they nitpick my case and throw it out?

                    The timelines I am looking at...

                    Filing Friday.
                    Waiting 30-40 days for the court date
                    Waiting for the 60 day time period (so I can join you guys!!!)

                    Anyway, 2 more letters came in the mail from a legal office... Zwicker & Associates out in Alabama. I had to forward copies over to them so they can include them in the filing.

                        OMG! You finally filed! WTG DebtMonster.

                        We will be filing our Chapter 7 on 9/30/09. I think our debt will be over $100,000 because we haven't paid on our CCs in a year. I hope we do not get scrutinized by the UST.

                        Dh gets paid every week, so we have 5 more paychecks to get to our 6 mth. lookback period. Right now, his gross income is $13,192.67. This week he made $105 driving Sun. night to Dallas, Tx & back. He didn't leave again until 8:30 pm. last night going to Cedar Rapids, IA for delivery tomorrow, so this paycheck will be small, also. He missed a month's pay when he was hospitalized in April & his first paycheck for March was $155.

                        Here's hoping the UST will NOT get involved in your case. Good luck on keeping your cars for a long time!

                          Not technically. That was just the signing of all of the paperwork. The attorney is going to file everything electronically tomorrow!!

                          I was thinking that they were going to bring a big stack of paperwork to the court house. They said they don't do that anymore. As of a year ago they now use software to submit the data straight to the court house so that way there's no clerk to deal with. They said in 3 days I will get a letter in the mail with my case number. WOOO HOOOOOOOOOOOOOOOOOOOO!!!
