creditors calling after only 15 days of late payments?

    we gave them our attny info too...but they said didnt matter since they are the original creditor they can call us they dont speak to an attny. our attny even sent them a letter didnt ease up the calls at all! like i said we did file yesterday and they are still calling me today! my lawyer said give them until friday.
    I wish i had let the debt be sold off to collection agency and they cant call if they get a letter from what he says but i guess that would of drug the calls out even longer!
    good luck i would say unplug the phone. We couldnt though because of the kids and kids friends and such so our phone just rings and rings i answer the calls starting at 8 am then about 10 am i just ignore them most of them stop by 8pm i had one the other day at 9:30 pm!

      I thought I was mentally prepared to deal with the calls. I was telling myself I could deal with them no problem.....

      But now as they started to come in im starting to doubt myself......

      Should I pickup them up and Say I will try and make a payment in a week or two just to throw them off. Should I even pick them up at all or just let the AM get them?

        I just dont answer the phone anymore...at first {late last year} I would answer and try to work stuff out but then it got to where no matter what I did they would continue to harass me so I just stopped answering the phone and thats when they started calling my work and my parents home{I have never givin my parents number out...ever so I dont know how they got it} Ive told them countless times not to call my work yet they continue to do so.
        CITI is the one who calls the most then next would be wal mart credit services..and I only owe wal mat $224,which is a creditor I could pay off but I was told not to.

          I will take the calls if I am home to a point, I also plan on recording the calls for my records and for when they get shitty and if they threaten me wit harassment.

            tell them you just do not have the money to make a payment and ask them to call you again in thirty days to see if your situation has changed. then make sure they make that note in the file.

            do not lie to them.

            they get paid by commission and will harass you to get anything they can. be firm, but polite.

            if they know they are wasting their time calling you, you may reduce the times they call.

              I just told them that we were unable to make a pymt. When I was asked why, I said, "The economy" LOL.

              I told them I would contact them if my situation changed.

              I didn't get hounded though. The calls became somewhat frequent but not constant. They had my cell # so I just left it turned off after a while.

                It depends on the creditor, we had some who called soon after the first missed payment and continued to call repeatedly, others who seldom called.

                  I changed all my accounts to direct to my cell phone. I keep it on silent ring all the time.

                  Citifinancial - 3 days started calling. I'm 10 days late now, calling 2x a day.
                  Cap One - 10 days started. Hot Linda has taken a break this week. I'm 3 weeks late now.
                  Wells Fargo Financial - 15 days. They are calling up to 15x a day now. 20 days late.
                  FIA (BoA) - 15 days. Were calling 5x a day, gave lawyer info. They stopped immediately.
                  Wachovia - 30 days started calling. They call up 8:00 - 9:00 5 times, 12:00 - 1:00 5 times, 5:00 - 6:00 5 times. 8:00 - 9:00 5 times.
                  GEMB - 10 days. Gave lawyer info right off the bat. Haven't heard from them since.

                  We'll be filed by 7/31 so it is a moot point talking to any of them at this point. I'm less than 30 on most and no more than 60 on any. I get calls ALL DAY LONG.

                  09/02/2009 - 341 Meeting - DONE!
                  11/02/2009 - Final date for objections
                  11/09/2009 - Discharged & Closed!!!

                    I stopped paying the first one on July 13 and by the 20th they were calling three to four times a day. Now I have about 6 that I missed the July payment on and the phone rings no less than 30 times a day.

                      I am using a phone from Viatalk.com which I like much better than Magic Jack. $265 out the door ($199 plus the taxes) for the equipment and includes 2 years worth of phone calls. You get many more feature than magic jack, including do not disturb and you can block ALL CALLS that say "UNKNOWN" on the Caller ID! It's SWEET!!! No more telemarketers, EVER!

                      I stopped paying my GMAC loan this month. How long before they start trying to call me?

                        If you intend to file, perhaps what I did may work for you too. I didn't answer a single call for over 6 months - just let them go to the answering machine and they finally gave up.
                        Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

                          If I am home, I answer and hang up immediately. That seems to do the trick. Some of them are stupid enough to try again right away and they get the same result. Of course, they just try again a few hours later! I can't wait to file and be able to tell them that they had better not call again.

                              citi finacial is like that here...the lady will call if you are 1 day late. Im 2 months late and she still calls daily and leaves the same message "please contact today so we can discuss your payment options" I can tell when she is in a bad mood as he message will say "Ive tried to contact you over your late payment..I need you to call me TODAY!"

                              another thing I noticed..alot of the automated callers,they wont answer until you say hello..some times you need to say it twice,then you get "please hold for the next available rep"...ummm yeah sure call me and put me on hold. so I usually pick up the phone and say hello twice and lay the phone down and walk away..or hand it to my daughter "sooo what you doin...no they are outside...Im watchin toons{cartoons}"..."hey he hung up on meeee!!!!"

                                I always answer the phone though it hardly rings any longer.

                                If the collector was nice I'd generally chat for awhile then give them my attorney info. If the collector was a putz I'd play with him/her for as long as I could always eventually insisting on speaking with a supervisor then repeating the same silly conversation with the supervisor.

                                Once I learned that I had control of this process not them I was not intimidated or concerned by their threats. Consider who is really on the other end of the line and what they can or can't actually do to you. Typically it's some bored person just putting in their 8 hours of work and could carel ess if you actually pay or not. And of course there is absolutely nothing this caller can do to you. It would have to be handled by someone much higher up the chain before it was anything that could cause you grief.

                                Answer the phone and talk as long as possible. It keeps the collector from being able to contact another debtor so long as you are on the phone with them. Do it for your fellow debtors!
                                Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
