    Day 34 of the "60 day club"...not much on Pacer

    Decided to cave in and look at Pacer and really didn't find much to look at. Status is "awaiting discharge", its noted as a "no asset" chap 7 case and there are 2 flags...BAPCPA, MEANSNO and that's about it. Everything else is docs our attorney submitted or filings. I was hoping to find something about the completed (June 25th) 341 meeting but its not noted anywhere other than it was scheduled.
    At the 341 meeting (very anti-climatic) the UST had asked for photo's of an old non running car I exempted under some wild card dough and said she was going to look into my mining claim exemption as she had never come across one before. I thought that was odd since Nevada is the greatest gold producing state in the US. I sent her the pics around June 28th. Other than that the 341 was a breeze....our biz (dissolved C corp) tax issues never came up.<yawn>....thoughts?

    I'm on about day 26 and am still expecting there may be a filing challenging exemptions on our car.

    I think the trustee has till Monday, August 3 to file something (that will be the 30th day following the conclusion of our 341 meeting). Anyway, I know they are very busy and expect to see something pop up at the last minute.

    Does anyone know for sure if I pass the 30 day mark (341 held on July 1st and on July 3rd the trustee filed that the 341 meeting was held and concluded--nothing more)--i.e., after August 3rd the Trustee cannot challenge expemptions and make it an asset case???

    Other than that, I wish Citimortgage would get off their butt and file a motion to lift the stay and get my darn foreclosure done!

      I have not been privy to any time frame restrictions on the trustees post 341. Can someone enlighten us? Lighten the mood a tad maybe?

        The UST has 30 days from the 341 to file an objection to any of your listed exemptions as stated in 11 USC 522, Rule 4003(b). This rule is uncompromising and inflexible. My 341 was on 07/01/09 and I am just waiting for that majic 30 days to expire.
        Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

          well then I guess I'm actually going to be sweating over the next 4 days. Because if the trustee does not object by Monday, August 3, than I think I stay a no asset case.

          However, given how many folks on here have had filings done against them at the 11th hour, I expect to see something Tuesday morning indicating that the trustee filed on Monday...

            Mine says the same thing "Meeting of Creditors Held" - nothing more.

            I have another 14 days before my 30 days are up. (I also exempted an old nonworking car).

            At least I am past the 10 days for the presumption of abuse, but the "totality of circumstances" wait is killing me...
