Well I was an over median debtor with 2 businesses (both failed) and was watching everyone else go through. Trustee very nice, everyone lasting about 2 minutes...until us. The main trustee asked our guy to ask some questions...three pages. It tooks us about 30 mins and got grilled. He was still very nice, but all kinds of questions. Even had a creditor show up. Very nerve racking, me and wife didn't prepare for that and were trying to not have different stories. Answered questions honestly.
Anyways, after all that, our atty calls and says she spoke to trustee and they are dropping all of those questions (I assume they didn't find anything) and are going to move forward on discharge, even letting us keep two cars that we own (they are both upside down).
My question about taxes was answered though. You can only keep earned income credits in Fl. I had pushed taxes to next year to offset any liability and he is making us pay that to the estate....so if you get a refund, spend it before discharge. He did ask someone before us he wanted to see bank statements on how they spent it, but had no objection to others spending it...so that may help someone else. Small price to pay for the amount of debt getting discharged.
Thanks to those who have helped me here. Great forum! If you have any questions from me...please ask.
Was told too that 45 days for discharge is now pushed 60 to 90 days here in FL due to the overwhelming amount of cases too.
