CC charges-is it 90 days from purchase or statement date

To be out of the automatic "presumed to non dischargeable " time frame do the 90 days begin on the day the charge was made or when the statement from the credit card company was issued ?

It is counted from the date of the last purchase.

Make sure of what the charges were and for how much. Although the line blurs a bit, small charges and especially those for basic necessities may not hinder your chances of filing, so discuss with your attorney.

What about last payment date vs last purchase date?

Let's say you made a purchase on June 1st and in July you came to the conclusion that you were not going to be able to keep up with it all. The July minimum payments were made. What happens if you stop paying starting in August? Do you have to keep paying minimums during that 90 days?

I guess my question is if I made purchases in June when should I stop throwing minimum payments away?

It really depends on the creditor and how large the transactions were. I had one credit card that I used up to like a month or so of filing. I asked my lawyer about it and he said living on your credit cards is what is getting you into this mess to begin with. Pretty much all the charges I made were like gas, groceries, clothes etc... didn't buy any luxury boat liners. I also had some balance transfers almost 90 days to the date of my filing.

The worst that can happen is the credit card company will dispute the charges and you do some work out with them.

I haven't heard a peep, knock on wood, from any of them and they all have zero'd out my balances on my credit report.
