Pre-Discharge Counseling

Still waiting for the counseling co. to issue my certificate. Monday will be 45 days after my 341 meeting. If it's in the mailbox by Monday, does that count as being filed, or should I give the clerk a call to beg them to wait for it?

It is 2 hrs to drive to the courthouse where I filed my bk, so I'd rather not have to drive there, but I guess I would if I needed to!

I made sure that the company I used for post-petition (pre-discharge) education, was going to e-mail it to me. I received it within 24 hours, and mailed it into the Clerk of the Court the same day (today)!

I don't trust any company that is going to mail it. Seems so... 1990s to me!

give a call to the counseling co. and tell them that if they do not fax it to you RIGHT AWAY not only will you demand your money back, but you will sue them for any and all damages incurred due to your bk possibly being dismissed. don't just wait, do something NOW. it's just not worth the risk.

what would probably happen, if you don't get it in time, is you will have to file it whenever it comes but enclose and explanation/request/motion to have it filed late. if you get it after they closed your case, you will have to file a motion to reopen (which involves some fees).
