    Reaffirmation question?

    I read on a recent thread about someone having a reaffirmation hearing. Do you always have a hearing? I thought you just signed papers. I am not sure if we will reaffirm so far nothing has come to us offering this. We said we would on our petition, but I really don't want to go back to court. So do you always have a hearing or is that something special circumstances make that necessary.

    I am sure this has been answered, but now I am rethinking this whole thing. Our attorney told us at our 341 if we get the papers all we would do is sign, nothing about a hearing. I don't want to draw any attention to our case, so now I wish we hadn't said we would reaffirm. Since we are current and still receiving "Info" only statements, I don't believe our mortgage companies intend to do anything to remove us from our home, why would they we have never missed a payment or even been late, so we maybe shouldn't have even offered to reaffirm.

    Reaffirmation hearings are usually Pro Se Filiers and reffirmation is signed by the Trustee.

    If you obtained an attorney for your bankruptcy, he/she will sign the reaffirmation.

      We're with BoA and also stated that we would be reaffirming, but after thinking a lot about it I don't think we are going to reaffirm either (unless we have to but I've read on here that BoA doesn't reaffirm anyway). From what I've read you just have to state your intention on your paperwork, but when it comes down to it most of the time you can just do a ride thru

        I would seriously reconsider reaffirming anything, particularly if you are upside down on the asset you are reaffirming. Plenty of threads on this board that discuss the pros and cons, but you'll find that the pros of not reaffirming far outweigh the cons. We didn't reaffirm our mortgages or cars, and are happily doing a ride-through. It's business as usual, and one of our mortgages is even continuing to report our on-time payments.
