    Trustee's Initial Report

    341 on 7/21. This was just filed today on Pacer:

    Docket Text: Trustee's Initial Report. The trustee of this estate reports that the meeting of creditors was concluded and the trustee is investigating the existence and location of property of the estate not subject to exemptions or security interests.

    I'm no asset - is this just a formality?

    I read that as "no decision yet". Myself and the others I've seen here get a "Report of No Distribution" that's pretty specific that there are no assets and the Trustee is requesting to be dismissed.

    Perhaps there was a question about the value you used on anything (like a house or a car close to the exemption) or any possibilities of pending law suit settlements, inheritances, etc.? Were you or your lawyer supposed to follow up with some pay stubs, tax returns, or appraisals just to verify what was said at the meeting and on the petition?

    It's possible in your district that the Trustee enters this to record that the 341 was held, and then follows up with the report of no distribution -- and it could mean nothing more than it's the normal process he/she goes through.

        Yeah, I was hoping for the notice of no distribution.

        I'm pro se, and there's no assets at all. No inheritance, no cars, no tax refund. We even have ~5k in exemptions left over that we didn't use.

        When she excused us she gave us all of our paperwork back and said she didn't need anything else.

          if you have the stomach for it, you could call the trustee and ask; maybe even the secretary could give you more info. you could also go on pacer and see if people who had the 341 the same day (typically they will have filed the same day as you) got something similar or not.

            I don't have the stomach to call, but your idea of looking on pacer was brilliant. It looks like about 60% of the people who 341'd on the same day got the same message as me from the trustee, and 40% got the no distribution.

            I got to thinking...she may be checking to make sure that the out-of-state house we are abandoning has no equity. In the end there's nothing else I can do but wait and find out!

              then it looks like this trustee is generally extra-careful. is this trustee relatively new? i didn't actually check, but i think most trustees would have a much higher percentage of 'no distribution' report than yours. so yeah, the good news is that it's not personal...

              i suppose you could also search on pacer for the previous time this trustee held a meeting and see how long before a final report was filed. in my district, each trustee holds a meeting about once a month. just be careful, it's 8 cents a page...

                I AM AN IDIOT. I just now read this and ran a query of the trustee's name, forgot to put in a date (honestly I didn't think it charged to run the query - it doesn't when I just run my name) AND PACER CHARGED ME THIRTY DOLLARS. I didn't even click on any cases!

                In the past, if I downloaded over 10 pages or so, I got a PACER warning first saying "are you sure"? This didn't do that at all.

                Is there a way to dispute a charge like that?

                  I'm going to answer my own question here, in case it comes up for anyone else:

                  How do I request credit?
                  If you believe there is an error on your statement or if you have a question concerning a transaction, please write to:
                  PACER Service Center
                  P.O. Box 780549
                  San Antonio, TX 78278
                  or
                  Fax (210) 301-6441
                  All credit requests must be submitted in writing with signature. In your correspondence provide your name, PACER login ID, and the dollar amount of the suspected error(s) together with a copy of the transaction in question. Please provide a reason for each credit being requested. When the PSC receives your request, you will be contacted by a service representative. Credits cannot be issued until after the quarterly statement has been generated.

                    when you write to them, emphasize that there was no warning!! in fact, if you were to click on a document that was over 30 pages, it would charge you only for the first 30 pages in many cases, so there is a limit. and it would tell you ahead of time.

                    you are not an idiot, you just weren't warned. and that's not fair. i hope they refund you.
