    mary, talking to an attorney will reduce your stress level! really!! i was told i looked 10 years younger when i came back from talking to him. just meeting took a huge weight off my shoulders. so please take our advice and go talk to a lawyer. you will feel relief.

    also, in my experience the stress level from not having information is very high. having information reduces stress.

        I'm stressing over something else right now.
        The bank I have the $3000.00 in I also have 3 credit cards with.
        One of those cards is due today.
        The other 2 are due Aug. 3 and Aug. 10.
        A $1000.00 of that money is for August rent.

        If I don't pay this card, will the bank freeze the money and screw up my Rent check, and will this look bad when I file BK (having 3K and not paying)?

        I opened another bank account last month to stop using this one eventually (now).

        This is the first time I am not going to make a payment on a CC and it's scary.
        I've had CC's since 1984, but was never in any trouble with them until about 2002, . . that is I always paid the balance off in full each month.

          If you have any loans with your bank including credit cards you may have what they call collateral agreements in force to where if you don't make the payments they can make them with your permission.
          We had similar problems and our attorney told us to change banks right away and we did.
          Also stop any auto payments you have now to avoid any confusion when you leave that bank.

            I might go back and meet with mine again then!

            Good advice here though. I was weighed down by everything and felt a flood of relief just seeing a possible positive ending.

              I may have to pay this one and mail out my rent check now and tell my landlord to cash it now.

                Good plan. Just make sure that you're new bank isn't Wells Fargo -- I've heard absolute horror stories about them!

                We just dropped BofA and went with a local bank now. They're a bit easier to deal with since you're talking to someone down the street, not a call center across the country.

                    Yeah BOA is great.... overdrafted by $15 once a while back but since it was on like 5 small charges (I don't carry cash - It disappears), it cost me $175 to borrow that $15 for a day until I got paid. Sure, I screwed up, but that seems a bit much. No luck getting help from their customer service department.

                    Makes me feel good to know all my personal info is going overseas....Maybe we should outsource all the collection accounts to the guys running the nigerian lottery scam....

                      I just wanted to chime in and agree with the other posters. Definitely talk to a couple of attorneys. We first spoke with ours in January and will not be filing until next month so that's more than six months that has gone by between our initial consultation and filing. Once we had our free consultation, we felt so much better understanding our situation better and she allowed us to have the creditors call her so our phone has not been ringing off the way with collectors at home or work.

                      You will feel so much better if you just talk to a bk professional about your situation. We are so glad we did!

                        Funny I went to Wells Fargo about 6 weeks before we filed from B of A as we had an RV financed there. I did this on the advice of the attorney.
                        Wells Fargo has not been a bit of a problem for us.

                          You stated above in the Bold and Underline that you opened another bank account. Go get that money out of Bank of America ASAP before you lose it. If you don't have checks, yet on the new acct. Take the cash you get from BOA and get a money order to pay your rent.

                          We have dealt with one Major Medical Crisis after another since 3/05. I've had 8 surgeries and I wrote earlier about bypass & pacemaker for hubby. He also had back surgery.

                          Get your mind set on the idea 'You could lose that money' because of it being it staying in BOA. Maybe that will be enough motivation for you to withdraw all that money today. Go to a branch, use the drive through & write a check out for cash for the $3,000. Yes, you may have some fees involved in the account later than today, but you can always Bankrupt those fees. You cannot get your $3,000 back though.

                            We just walked and and told the teller we were leaving the area and were headed into Mexico to live.
                            It made it easy for them not to recommend just staying with B of A in another town we may be moving to. It just eliminated questions.
                            We drew the cash and went to Wells Fargo and put the money in there.

                              I have one of those cards due in 3 hours.
                              I'm mailing my rent check now with instructions to cash it right away.
                              I don't have checks with new bank yet, . . I just ordered them.
                              If I don't pay this CC, I don't think they will freeze my account
                              right away before the rent check clears.
                              I'll get the money (minus rent) out now though.

                                Nobody will do anything when your cc is barely late. You probably wouldn't even get a courtesy call for 30 days.

                                I've never known what hour of the day a bill was due. I always thought I had until 11:59 p.m. on the due date.
                                Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
