Question about debt owed to State..

First of all , I just want to say thank you to everyone who posts here -- I've been reading page after page of info & personal experiences for awhile now --and it's been a tremendous help!!

Now for my question...

Dh and I just filed a chpt 7 no asset BK this month. Ofcourse after filing I remember that I owe a debt to the state for an over payment of public assistance benefits from 2001. There are a couple of items left off of our schedule F which I planned to modify myself after our 341 next month. I believe the debt owed to the state is considered an unsecured priority claim though so I'm not sure how to add that to the amended paperwork. Or maybe this is something that needs to be done before our 341?? Am I going to get a hard time from the trustee for this not being on our forms before our 341?

I'm not sure of the procedure, but why wouldn't you want to get it amended and fixed before the 341?

It's not that I don't want to amend it before the 341.. I just figured I would hold off in case I think of something else that needs added

i would amend prior to the 341. i feel things would go more smoothly. otherwise the trustee will end up having to look a second time at your filings which might feel like a waste of his time. if you amend before the 341, the trustee will see the amended version when he looks at your case the first time, and won't need to look again.

i would suggest filing by a week before the 341, because that's when the trustees start looking at cases (because that's when they get the tax returns and paystubs).
