    60 Day Club?

    On 6/9 we filed Chapter 7.

    On 7/16 we had our 341 (No problem at all, like 3 minutes tops).

    On 7/17 Chapter 7 Trustee's Report of No Distribution was put in.

    On 7/18 they put in a Notice of Filing Report of No Distribution, Combined with Order Fixing Deadline to Object Thereto. On this report it says the last day to file an objection is 8/17 otherwise the Court will presume the estate is fully administered and proced to close the case.

    What is the difference between the objections due deadline of 8/17 and the other date from older paper work that said 9/14 is the last day for objections to discharge? Seems odd.

    But regardless we are on the way to being done with this!

    was your case an asset case originally?

    i believe the deadline of 8/17 is for creditors to object to the fact that the trustee does not intend to distribute anything, which means the creditors get no money from the estate. i think they could object if the trustee abandons non-exempt property (which is why i asked if you started out as an asset case).

    this is the first i hear here about someone actually getting such a deadline fixed; i actually thought i should have such a thing but i don't. so i am very curious about your notice! if you are able, would you mind posting the exact wording of it or scanning it in (leaving out any specifics, of course)? i would appreciate that very much!!

    the 9/14 is the date to object to the actual discharge.

      just noticed, 7/18 was a saturday, who on earth posted something on pacer on a saturday?

        Oh yes, they can. Most bk lawyers have access to PACER and the software automatically posts it. They are also so back logged that perhaps some clerks are working o.t. to get the legal up in a timely fashion. I've seen this before on our case. 'Hub

          We were never an asset case. Here is the notice:

          NOTICE OF FILING REPORT OF NO DISTRIBUTION

          ** You might need to click on the image to view it full size in your browser **

          The wording of the notice just makes it sound like our case could be closed before the full 60 days is up. But I guess the notice just means that they have till the 17th to object to the fact that we are no asset... we still have to wait till 9/14 for any objections to the actual discharge.

            thanks so much for posting that! it looks like a local form, though i couldn't even find it on the CA website. maybe its a local trustee form rather than local court form. no idea.

            yes, that notice is very confusing - it sounds like the case can be closed regardless of discharge.

            in any event, after 60 days the hamsters will be on their way!

              Keep in mind that the courts are pretty busy right now. It took 74 days in my district for a simple no assets case to get discharged and another 10 for closing.

                Ya it just seemed odd... they make it sound like after the 17th it could be closed. Oh well...
