    Some advice please...?

    I recently filed a bankruptcy chapter 7 case in the state of California. I had no funds to pay for an attorney to assist me in the process, so I was getting some legal assistance from a non-profit bankruptcy assistance program.

    I completed all my courses, went to all of my court hearings, and paid all my fees, but have yet to receive my bankruptcy discharge notice. The other day, a man came to my front door demanding funds for a vehicle that was included in the bankruptcy. I gave him my case number, and he returned later stating that the bankruptcy had been DISMISSED, and still wanted financial payment of some sort.

    The non-profit organization has since been disbanded, and the offices vacant so I have no legal assistance with where to go to now. The last notice that I got from the courts was NOTICE OF ENTRY OF ORDER IN A BANKRUPTCY CASE dated 04/10/09.

    Any advice would be greatly appreciated.

    You need to sign up for a PACER account and see what your status is. Here's the link
    http://pacer.psc.uscourts.gov/ It's free to sign up but it costs .08 per page for every page you view. Sign up for an account and then log in and search for your case by your name and social security number.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

      Do you have a PACER account? If not it would do you well to sign up for one. Here is a link to PACER:

      PACER provides information about accessing and filing federal court records electronically. Find resources for using PACER.


      Or if you live close enough to the courthouse for it to be feasible to go in to the clerk of the BK Court and look at your case, then do that. You need to see and possibly make copies of all the paperwork that is there.

      PACER charges $0.08 per page to view them. That doesn't seem like much, but it quickly mounts up. When we check our case, when something new shows up, we save a copy of it--with a meaningful name--to the Bankruptcy C7 folder on our hard drive.

        I should add that when you sign up for PACER you will be emailed a username. The PIN number will be the last four digits of your SS number.

            You were represented by an attorney if you were receiving legal assistance. You can find your attorney and insist he complete the case for you. If an attorney was involved he was most likely doing pro bono work and can't just walk away from you because the agency disbanded.
            Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
