time frame...

    time frame...

    our atty is going really slow....our 6 months is supposed to be jan-june...and we were supposed to file the first of july....we signed the paperwork and paid the second installment of what we owe on Jul 2nd and we are STILL waiting for her to file it....Now I figure she's waited so long that we may have to redo the paystub stuff and it might take even longer...we want this to be OVER so bad and we should be staring down the nose of our 341and we are not even officially filed yet.........

    I guess my question is...will this two weeks affect the paperwork and require changes that will now take more time???

    First off have you paid you're Attorney in full yet?
    He won't file until he's been paid in full because if not what is left would end up being discharged in a chapter 7.

    To answer you're question all you're income will have to be up dated because they want to know how much you have made up to the day of filing.

    The Attorney will also need any new credit card statements and correspondence from debt collectors with updated totals.

    At least that is what my attorney was asking for while dragging us through a small knot hole.

      Don't worry too much, we ran into the same problem. She just punched the new paycheck info into the computer it did all the figuring for her. Just keep all your stubs. Maybe you should contact her and see what date she is looking at. Don't worry about being a pest. It sounds like most of your info most likely is up to date, just keep everything and take it with you when you file. We went over all our papers and updated everything with the paralegal the day we went in to file.

      I was on Pacer Again! and saw our attorney has more then just us he is working with, he is representing quite a few from the county I live in and he isn't even in this county so I have no idea how many cases he has. Alot I would assume. I got frustrated waiting once we said it was time, but they got it done and we got filed.

      I know that isn't too comforting right now, but just keep in contact with them, and it will be fine.

        We paid a $600 retainer...and $299 the day we went in to file (but it never got filed) and then we are supposed to pay her the remaining $400 the day of the 341. This is her payment timeframe....

          The 6 month look back period is always as of the last day of the prior month. Any filing in July looks at January through June regardless of the day in July it is filed.

          However, cash on hand could change on the schedules depending on when the case is filed.
          Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
