    Objections Due from whom and by when?

    Hi everyone. Thanks so much for this invaluable resource. You are all fantastic.

    I have a few questions. Here are some facts:

    *Chapter 7
    *No asset
    *~90K unsecured debt
    *100K Salary
    *Passed means test with about -$900 each month
    *No presumption of abuse
    *Had 341 meeting, quick and painless
    *BK trustee entered report of no distribution, no assets requesting relief from duties on 7/10/09

    What happens next? I have heard that US trustee has 10 days (is that working or calendar) to object, but I have also heard that he can object up to 59 days later as long as before discharge. Is this true? Where are my facts wrong?

    Also, the BK trustee's report says objections are due by 8/10/09, which is one month after the report was entered on the docket. What types of objections?

    What to expect from here? Anything I'm leaving out that I sure be looking for or concerned about?

    We got hit on day 58 for abuse. Never heard a peep. He wasn't even at our 341. I think they look for things that make stand out. Above average mortgage (this is what got us), kids in private school, high debt or high income.

    My theory is that the USTs are getting more involved. The justice dept is receiving alot of new money. I bet the UST office is trying to make themselves look super busy so they can get a handout. I noticed on our scheduled day for court, our UST has 4 other cases the same day.

    The 10 days is to object to your means test. If the reg trustee didn't have a problem, you are probably ok. After that they can get you on presumtion of abuse.

      Mixer99. You worry too much. Wait until you have something to worry about. Whatever they do, they send out to all the Matrix and your creditors have a right to object, it is normal operating procedure. Nothing more. 'Hub

        Cat is right. Don't spend too much time worrying about this (I am guilty of this). Excluding the time to get the original papers to the lawyer to file, I have spend less than 10 hours of my life dealing with this - and we have a UST on our back. BUT I have probably spent 100 hours worrying, reading over every piece of material I can find. And numerous sleepless nights. Looking back, I could have spent that time with my my kids and their kids.
