    strange letter

    Got a letter in the mail today from a debt mediation company offering to mediate between us and U.S. Bank in a claim that has been filed against us in the county we live in...there is a claim # and everything....we filed last Friday...could there be a claim against us without us even being notified??

    I got one of these a few months back. In my case it was snet because Citibank had just filed suit agaist me for on of my cc's.

      Their claim number means NOTHING to you. It is not legal. If you wish me to make a claim number on this post, I can. I claim I posted to you.

      That silly stuff being said, make no offers or correspondence with anyone if you intend or have filed. This is called preferential payments outside of your legal rights and you just may screw up your bk.

      Understand, salesmanship is an art. Look at our Govmint.

      They may tell you anything that is appealing to you. Ask your lawyer of course, but make no action on your own if you intend to file. 'Hub

        Yes, I agree this is most likely nothing for the OP to worry about. It probably applied to the debt pre-petition. Now that the OP has filed they are protected by the automatic stay. At most this "claim" is something US Bank may havefiled in state court. After filing BK you follow the federal Bankruptcy courts rules

        With all due respect 'Hub, I still do not understand why you keep stating that

        A preferential payment to your aunt Betsy may screw up your relationship with your aunt betsy when the trustee sues her to get that payment back, but a preferential payment to US Bank isn;t going to screw anything up for anyone except US Bank.

          I had two creditors file suit against me, both times I got a letter from a legal services company telling me that they can help me with a personal matter involving X bank... which was by the way ON the envelope. These are bottom feeders sending out these letters to anybody who has a collection suit filed against them.

          It is well researched junk mail. Toss it and move on.

            Just give a copy of this to your attorney. I don't think this means they have filed a case against you, I think a "claim number" is different from a "case number", but just let your lawyer know, it may be a violation of automatic stay.

              A claim number is what you use to retrieve your coat at the banquet coat check window. Always remember to tip the coat check clerk!
