Can I file for chapter 7, my last chapter 7 was done in October, 2003.....
The bk law changed in October 2005. Now you must wait eight years from your 2003 Ch 7 filing date before you can file Ch 7 again and receive a discharge.
If according to the required Means Test and Schedules you have sufficient disposable income to support a Ch 13 plan and your secured creditors will receive what they would have received in a Ch 7, then you can file a Ch 13 now and receive a discharge after your Ch 13 payments are completed.
