341 Question

    341 Question

    Thanks to those who responded to my earlier thread. Just a quick reminder, we are a C7, no asset, no presumption of abuse.

    I have another question which I am sure I already know the answer to, when looking at our judge's calendar for that day we are not on there. When I read our 341 meeting it says we meet in a room.

    So do we even go before the judge? I think I already know the answer and the answer is no. We just see the trustee.

    So how many days after the 341 should we look at pacer? I mean I can't seem to help myself from looking at pacer, it's an addiction now. Today I looked at it shows our financial classes have been done. We sented all the papers the trustee asked for to our attorney on Monday so obviously the trustee has them now.

    I hate to be a pain here, but refresh my memory, after the 341, what happens? I know our date of release is Sept 18th. What goes on from the date of the 341 (july 20) til Sept 18? Creditors objections I know, but what will the trustee be doing? Have they already reviewed all the papers we sent over when we filed and they review the papers requested after the file date before the 341 or after the 341? Sorry if this is confusing, but I spent to much time away from this forum and have forgotten exactly what happens during the waiting time before release.

    Thanks to all who wished us well! This forum is a blessing and I look forward to seeing the responses to my questions. Without this forum I am not sure how well we would have prepared for our BK.

    The 341 is just before the trustee, the judge will not be present. In 90% of cases you never see the judge during the process.

    After the 341 creditors have 60 days to object or not, and to file claims in asset cases, after that you are pretty much home free and depending on case load will be discharged/closed in many jurisdictions.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      thanks JR, to be honest I knew the answer, but I was confirming what I thought I remember.

      We drug our feet so long on filing some of the things I knew I forgot!

      We started this 1 1/2 yrs ago, before they admitted our economy wasn't good. We started this back when that one president kept telling us our economy was strong and I kept thinking, what is wrong with US cause it sure doesn't feel like OUR economy is strong. Now more and more people are filing, due to this economy that has been bad for a long while. When I was on pacer, I was amazed to see how many others are in exact same boat we are. Got to stop that or I will owe pacer way too much money!

        I think they invented pacer just to get more money out of us.

          I never was sent the bill for my PACER use.

          I had a good attorney.

          I only checked PACER generally 3 times a week. Monday, Wednesday and Friday. There is no need to check it more than once a day as it is updated once a day, at the close of business for all districts I believe.
