    Phone plans

    I am getting my paperwork together and was wondering, do to needing to cut costs, I am going to drop my present cell service and go with pre pay as it is cheaper. But that means I am breaking my contract. Can this be included in my bankruptcy? I will pay off what I owe bill wise, but am looking at a $175 termination charge I would like to include if possible.

    Also I keep getting letters from a collection agency on a debt I have paid off, in fact they tried to sue me and it was thrown out when I produced papers showing it was paid. Should I just go ahead and include it, even though it is paid off?

    as long as you do the termination before filing date, it can be included in bk.

    to be safe, list the debt you paid off in your bk papers. just mark "disputed" in the creditor matrix.

      I would include the latter debt, and just check "Disputed" on the schedules.

      I can't see any reason against including it (unless you're at the unsecured debt ceiling trying to do a CH 13), and including it will just finalize that it's a closed matter.

      No suggestions about the cell phone. How close to filing do you plan on stopping service? I included some cell phone bills and early termination fees in my BK, but they were probably two years old.

      I doubt it would be much of a problem anyways for what is likely a small amount in comparison to your other debts, but even less if you stop paying/service 90 days before filing.

        My hope is to file by mid august if I can scratch the $300 together. Right now budget is real tight and trying to by a useable car at local goodwill auction since I am turning my car in with the bankruptcy. The phone bill we be paid in full, I just know I will get hit with a early termination fee. Going pre paid to avoid that in the future. My debts are limited to CC and a car loan. I own no property and have no assestes. I bring home $1300 a month of which almost half (615) goes to my monthly rent, which doesn't include utilities.

          Stop me if this is wrong but why pay the cell bill at all? Why not go today to get the prepaid and be done with it. That way the money you would have paid to the cell phone company can be used toward your prepaid balance.

                Can you use any phone on tmobile prepaid or just the phones they offer?

                  Cell phones are a huge ripoff.

                  You can use any GSM 1900 capable phone on their network. Or a WCDMA 1700 capable 3G phone.
