landlord might be notified if you have a lease (as opposed to month-to-month), depending on how your lawyer does it. employer won't be notified unless he is also a creditor.
Really? I don't understand why my landlord should be notified! My roommates and I have been current and on time with the rent for 3 yrs! Thanks for the info though...
nobody understands why the landlord sometimes gets notified, and often he isn't. some posters have said their landlord was notified because of some rule that says all leases must be reported in the bk papers. since it's completely pointless, and i am sure they did not mean to inform a private person's landlord of the bk when they wrote the bk code, i think there is some leeway and many lawyers may be willing to bend the stupid rule and keep the landlord out. if it's important to you (yes, of course it is), then convince your lawyer to keep it out. it serves no purpose.
oh, i forgot: you may also need to mention your landlord if he is holding your security deposit. however, if i remember right this does not lead to him being notified (unless the trustee wants the security deposit to pay creditors, which i haven't yet heard happen from anyone on this forum).

I've been trying for months to get my lawyer to take my landlord off the mailing list. But he won't do it. Says they have to be notified. Didn't make any difference whether I was on a lease or a month-to-month. Believe me, I was not a happy camper.
So just ask your lawyer. He/she will be able to tell you one way or the other.
Our house is owner financed and the very nice couple who financed us is on the mailing list..but the lawyer just put their name and city..no address or zip...so it would be returned undeliverable;)

So long as it's not Mayberry RFD or other similar town it's a great strategy!

I do hate the way those BK mailings say BK in bold on the front. It sucks.

Yeah, it's a small town...so we thought of that! This has been such a stressful experience...I'm just not going to worry about it....We are one year into a five year contract with them at which point we are supposed to get a loan....surely in 4 years our credit will be back up to par enough to get a loan for $100,000!!
