    Discharge: My excited / reflective post!

    It's official, as of today- discharge!

    Thanks to everyone in here for your advice and companionship, even when I was initially just lurking. It was a big help, and made the process a bit less scary.

    I think we're going to be okay Now that we've been discharged, the apartment we were applying for is sure they can get us in. I've gone through our budget with a fine-tooth comb, and whittled it down to the bare minimum- just under $1,100 per month. That gets us two reliable cars we actually own, a big built-in-2007 riverside 3 bd / 2ba apartment with lots of perks, two cellphones, cable tv, internet, and all monthly utilities, insurance, gas, and misc. paid (ask me if you want details, I feel pretty clever about it). Planning for the worst, I could fall back on Walmart or a temp agency and still make ends meet for my family!

    For the next 2-3 years, we're going to work on getting a stable job and rebuilding our credit, so we can think about owning a home again. As of next week, we will miss our first payment on the upside-down home IIB- ironically, the mortgage payments were about what our new total monthly budget will be. We'll probably stay here another few weeks to save up money, then turn it over to the bank. I'm not sure we're even sad about losing it, anymore... the peace of mind of having everything paid for / paid off, with nothing hanging over our heads is exciting.

    Last word of advice for everyone: rethink things. Don't take anything for granted. Just because you've always had a newer car, big house, or lived a certain lifestyle, doesn't mean you should continue. You're here for a reason! Make it a goal to work back toward that, if it's important to you. In the meantime, listen to the advice here. Put pride on the back burner, and do what you need to to secure your future. The I-need-it-now mentality is a carefully cultivated trap which you CAN escape. Good luck all

      May I ask why you're not planning to stay in the house rent-free for several months while the foreclosure process works its way to conclusion?
      Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

        We'll stay as long as it takes to get into the apartment, maybe a little longer- likely about a month. Part of the rush is that we don't want to miss the apartment opening. It's newer, nicer, bigger, and half the price of our house! We don't want someone else to grab it. If we hesitate too long, we could be stuck waiting for their next opening, which could be 4+ months away.

        Also, no one has given us any kind of time limit on how long it takes before they seize the house, but our lawyer warned us that since it was included in our Ch7, if we miss a single payment, they can immediately take it back. Perhaps that's specific Utah law, perhaps she was being overly cautious, perhaps she's just aware how Evil Wells Fargo is; I don't know. But the idea of not knowing when they could take it... we'd much rather have a planned move before we're accused of squatting

          Wow, $1100 for all of that?? I pay more than that for JUST rent......although I live in CA! LOL.

            How long is the average time it takes for the bank to evict you after a BK7 and then foreclosure? I'm in NY. Should I keep making payments while the BK is in progress?

                me too, $1350 a month just for rent, and thats a 2 br, 2 bath. im moving to Utah!!! i love so. calif climate, but i hate living here. its like living in a very expensive third world country. congrats on that discharge. i to am living within my means, and its hard!!! but it can be done. i didnt realize how much i depended on cc's till i filed. its a lifestyle change that can be tough to correct. i learned the hard way, as usual...

                        Actually, the cheapest decent 3bd here in the Provo/Orem area is about $800. We're heading up to a small town in Idaho because we found that 3bd / 2ba for $564. Big cities = big money. We got offered a 3bd farmhouse a few hours more north for $400/mo., but didn't want to get to far away from friends / family in Utah.

                          thats amazing. i am going to seriously look into moving in a year or so. in my city(90505 zip) houses are still going for half a million, its insane. good luck in your new place
