    Filed Ch 7, no asset, no presumption of abuse!

    We finally filed, took almost a year and a half. Things came up, wanted to make sure we timed it right and it appears we did.

    We filed on June 6. We have our 341 on July 20. We are a no asset, no presumption of abuse. I have been on Pacer almost everyday since we filed and so far nothing is appearing that makes me nervous. I guess I am praying now things go good at the 341.

    I am just curious since it says we are a no asset, no presumption of abuse can anything happen now that could change that? I know stupid question I am sure, but I just wondered. We fell about 20000.00 below the median income for our state. What happens after the 341? Has the trustee already looked our paper work over before we show up at the 341? I am probably being stupid here. We are current on our 1st and 2nd mortgage as we intend to keep our house. The biggest problem right now is getting our house payment paid due to not being able to pay online. It's a pain. We ended up paying late due to this, but included a late payment. First time ever in all these years we have ever been late! I can't wait to get back on auto pay.

    Any advice for this wait? I am surprisingly not to nervous about the 341, I just want this over with.

    Hi and Congrats on finally filing...I'm sure it was a HUGE weight lifted off your shoulders
    We finally filed too after a year of "planning" and had our 341 recently. It's exactly as everyone says, "no big deal, in and out within 5 minutes" I wasn't nervous at all, I think after a year of "waiting to file", here everyday reading, I knew what to expect and that calmed my nerves some. I checked pacer too everyday, but it wasn't until AFTER the 341 and the "Trustee's report" came back as a "no distribution/no asset" case. Yep, I'm mailing in the mortgage payment too, can't wait for my online account to be restored...

      Lots of us have our 341 on July 20th! I think its a good luck day. ;)

        the trustee most likely won't look at your file until a day or two before the 341, which will be after they get the tax returns/pay stubs from your lawyer.

        a trustee can change a no asset case to an asset case only if they find assets not previously reported, which won't happen. also, sometimes trustees change a no asset case to an asset case if they decide to take the person's tax refund when it comes.

        my suggestion: get off pacer until a few days after the 341. looking all the time first of all adds up (8 cents a click becomes a dollar in no time!), and second makes you nervous in anticipation of a change every single time. the fact that nothing appears should not be making you nervous! no news is good news.

            The UST has 10 days after the 341 to file a presumption. You should be fine though! Good Luck on your meeting and congrats on filing!

            5/09 UST now involved no idea what happens next
            7/09 UST has decided to withdraw his motion to dismiss!

              I just opened an account with Wells Fargo (my mortgage is thru them too) and I went to set up Bill Pay for the mortgage and was told to call the 1800 number...I have to mail it it or call and be charge $25 for a phone payment! Sucks!
