    Amending a petition...for a $25 debt

    I met with my lawyer today and told him I may have forgotten a creditor. I had a department store card that only had a $200 credit line and I defaulted on it years ago. From what I recall, I was never chased after for the debt and it doesn't even show up on my credit report. My lawyer told me to haunt down the creditor and see if they have any record of my account and, if they do, we can amend the petition if we need to.

    To make a long story short, while trying to track down this account this afternoon, I discovered another creditor I forgot. It's eBay. They want $25 for some fees I incurred last summer when I sold a handful of DVDs online. Obviously, I'll let my lawyer know about this, but does anyone think it makes sense to add a creditor to my petition when the cost for an amendment is $26, more than the original debt? (Plus, there's lawyer's fees....) I guess I could pay eBay off at some point, but I don't want that to look like preferential treatment.

    I know a lot of peeps will tell me to talk to my lawyer and I will, I'm just curious what other people would do and if they've had experience with a similar situation. It seems silly to me to pay mega-bucks to amend my petition for such a small debt, but I don't want to do anything wrong either.

    My attorney charges $201 for any amendment...so I won't be changing anything. If it eases your mind, pay the $$ for the two amendments, but I was under the impression that *any unsecured* debt (that was before you filed) is discharged even if it wasn't listed/forgotten on the petition. I'm sure someone will come along and correct me if I'm wrong.

    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      I was told the same... I was told you have 1 year from the date that you filed that you can send a copy of bk case to a creditor and even if was forget it was okay they still discharge it...

        I accidentally left off a creditor. When I got the bill, I made a copy of my discharge and mailed it off. Haven't heard a thing from them since.

          yes, the debt will be discharged even if the creditor is not listed as long as you are a no-asset case.

          it's not worth the $26 plus fees to do it.
