My car was just repo'd

    Thanks for sharing that. I gave 6 months of bank statements to our attorney with the past 3 years of tax returns. They have everything on me that there is to know. 100% of the income I make is reported. I never get paid in cash. So they see everything in black and white.

    So as long as I have hired an attorney, he should show up for the 341 meeting and not me, right? Or is this the meeting where I show up once and the judge asks me the 4 questions and then the attorney takes over from there?

    I remember him telling me that I have to show up just one time. So I am wondering if this is that one time where I need to show?

    Will Best Buy come and want the TV we bought in 2006? Or will HSBC come and say to give back the BowFlex? They can have it! We have no room to store it.

      Which would be great if you actually had that $1050 that you aren't paying for the car loans each month. But you don't, which is what is going to make it kind of difficult to "stash it away."

          The car dealers are great at moving money around in different places. I have learned how to do the same.

          You guys need to learn how to not work on a W2 income and you'll eventually learn the tricks. I don't miss working for the man. At least I make about $4,000/mo., just under the median. We're not paying any bills other than a cell phone and utilities. The rest we keep! Booo yaaa!!!!

            So if your making 4k a month why do you have to file ?Maybe now you can add some more gadgets to your bowflex machine and get that new bmw again

              $1,000-1500/mo. of that goes to taxes and business expenses. Where I live now, housing costs an easy $2,000/mo.

              I can't afford to pay for future debts and drag $360,000 worth of old ones with me. I need to break off from all of that old crap. I will never be able to own a vehicle without worrying about some zombie debt collection agency coming after me and slapping a lien on a car that's paid off. That did that to a friend of mine and he had to pay $7,500 to get his car back. Forget that... for a few grand this will all be washed away and I can move on with my life and start fresh.

              Bankruptcy will be fun. I recommend everyone to do it. It's like a Spring Cleaning!!

                Let' see - this attorney is going to cost you probably $3500+...now do you see why your first attorney's fee was so high (your other thread with your disappointment as to your first attorney)? You have an extraordinary BK due to the large number of creditors. So this attorney wasn't as cheap as you thought he would be and I certainly wouldn't get your hopes up as to keeping your car that long from a secured creditor that is not being paid. Just think if it was you that sold the car to someone and they were to contractually pay you monthly payments and they stopped paying and kept trying to keep you from taking the car back because they were not paying. I don't think you would sit back and let them keep it for several more months for nothing and let them depreciate it more. I think you will see the repo man sooner than later. If it's too good to be true, it usually is and those of us on here long term have never seen anyone post being able to keep a vehicle from being repossessed and they continue to drive it for nothing. I hope your attorney has a good reputation in your area and you investigated him and his past record as to these "claims" of his. Even you were not aware that something like that could be done. Did you first investigate what he told you before you signed anything?

                  The first attorney was telling me to give the car up right away. This new one practically insisted to keep both of my vehicles. I feel 10x more confident in this guy.

                  All of mail goes to a Mail Box Etc. Nobody has the real address where the vehicles are since I moved. Right now the repo companies have been on a wild goose chase. They've been searching for a car that's 350 miles away from the place they are looking. I never forwarded my mail. Every few weeks I'll drive back to the house to check my mail and cut the lawn and what not. That house is free storage until it finally forecloses and they tell me to get my stuff out.

                  I explained everything to the lawyer and he was okay with it all. I won't give any vehicles back until my attorney instructs me to. I just checked out Auto Trader 5 minutes ago. There are TONS of used cars out there that are like new with less than 10,000 miles on them for under $8,000!! I could easily pay cash in December for a used car.

                  I am not sweating this. I am not going to let these people repo the car. There's no law saying that you have to give it back just because you don't pay.

                  Look at all of the people who rent a home and stop paying rent. They get to live in the houses for months or a year or so before they finally get kicked out... just like with the foreclosures. Until my attorney or a judge instructs me to give the car back, I'm not giving ANYTHING back. I'm going to keep it and keep racking up miles on it. Lucky for them I'm not putting too many miles. It's a 2007 and I have about 34,000 miles on the SUV and 75,000 on the 2007 sedan. You down with it?

                  I will keep you guys posted.

                        I am not following debtmonster also? Why are you filing bk if you are able to save such a large amount of money? Did you compare BK to a Spring Cleaning YIKES!!!! Most people on this board really filed BK because they had no other choice. Good luck, hope everything works out in your favor.

                          If I ever want to finance a house or buy a new car, I don't have a choice neither!!!

                          My bills totaled $6,200/mo. How could I possibly save anything? Now that I am stop paying on everything, WE CAN SAVE! The whole reason we couldn't save is because we were paying creditors!!

                          We are learning to live within our means and making credit no part of our lifestyle anymore.

                          The hospital should have turned me away since I did not have health insurance the way they do in other countries. Now I'm including almost $40,000 in medical bills into the bankruptcy. You down with it?

                            You haven't paid your mortgage, rent, car payments, or any other creditors for several months, yet you still haven't been able to save a dime. According to one of your recent posts, you were down to $29 in your account.

                            Wow, you make a whopping $2500/month net after paying taxes and business expenses? You're bragging about this? You have no health insurance, no home, and 2 cars that are about to be repo'd any day now. You don't even have the means to support yourself on that salary, let alone pay cash for a new car 5 months from now. You need a reality check.

                              yes, I the 341 meeting is the one time you will have to show up in court and answer a couple questions. Everybody says it is pretty painless and quick. What if you can't keep your car that long, will you be able to get around until you can save up to buy a new one?

                                I believe you stated you are staying with inlaws. It is so easy for them to find the vehicle there. Only a matter of time. As another poster said, what are you going to do when they do get that vehicle (to which they are entitled since you are in breach of contract and have stopped paying and agreed to that when you signed the loan paperwork). Will your attorney be there at 2:00 a.m. some early morning to prevent the car from being repossessed? How much have you been able to save since you have not been paying your bills. If you haven't been paying them for several months and have no rent or mortgage payments, you should have quite a bit saved up, even after paying for the attorney. Is your attorney aware of the funds you have saved? You will have to provide recent bank statements up to the date of filing... I see a crash and burn waiting to happen here unless you toss some reality into this situation. I just don't get some of the things in your postings (and it appears others don't either) probably because we are just hearing one side of the entire situation.
