    My car was just repo'd

    after missing 3.5 months of payments. At least the guy knocked on the door to see if I wanted to get my carseats. He got lucky with a full tank of gas

    Was he suppose to give me anything? He showed my husband the paperwork saying my bank had a repo order out on me. He also said he came by at 2am a few nights ago but saw the carseats and decided to wait. I have no paperwork from him though (then again I don't know how these things go?)

        I am so sorry to hear that....if u would have filed you could have held onto your car during the BK. At least the repo guy wasn't a jerk!

          Yes hindsight is 20/20.. I sure wish I was able to come up with another few hundred before this happened. At least I know I couldn't have afforded the full coverage insurance for it anyway (my policy expires this month)...

            Do you plan on filing pro se, or do you already have an attorney retained? Just asking because when I had my attorney retained, but my case wasn't filed yet, he had told me that if my car gets repoed, and if my case was filed in a matter of days after the repo, I could get it back.

              What is the process?

              I am going to file and not keep my car. I am planning on filing around the middle of this month. Presently my next car payment is scheduled for July 9 and I will not be making it. As soon as file and the loan company is notified can they come and get it? I know it varies by loan company, but about how long can I expect to keep the car before they come and get it?

                Once you file the loan company will be informed. During your BK process which can be anywhere between a 4-6 months process, just depending on the district you plan on filing in. The car should stay with you during the process, I think it is called a Motion to Stay (something like that). The car company can't take the car away from you while you are in BK (your protected). Unless your car company objects to take it. Are you filing Pro Se? If not you should contact your lawyer just to be on the safe side. But I think you are going to be safe. You can always contact the loan company, and ask them to come get the car. If you don't want to keep it during your BK.

                  I'm sorry to hear this happened but glad to hear that he was kind enough to see carseats in there and knock on your door. You will also have an opportunity to remove any of your personal belongings from the car at the impound lot. It happened to me.. twice
                  12/05/08 - filed pro se
                  01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
                  04/01/09 - new 341 scheduled
                  6/02/09 - DISCHARGED!!!

                    filing myself

                    Yep I am filing myself, I only have CC and car loan debts and have no assets so it is very basic. I just wasn't sure what happened if you don't reaffirm the debt.

                      Why couldn't the nice repo man show up at my house? A few days ago USAA repoed my car, but we filed on June 11th. They are in direct violation of the automatic stay. I have another post on it here. Still haven't returned the car. We'll probably have to fight them in court. As if filing BK isn't stressful enough, we certainly didn't expect this to happen.

                        I'm sorry to hear that but at least he was nice enough to let you get your carseats.
                        4/09 Converted to a Ch 7 due to loss in dh's income
                        5/09 UST now involved no idea what happens next
                        7/09 UST has decided to withdraw his motion to dismiss!

                              I've already taken everything out except my daughter's booster seat and I've been buying $10 of gas here & there instead of just filling up once a week. lol

                              If they do repo, don't we need the tags and registration to turn those in?
