Very happy the preparation for filing phase is over, 341 is now set for 8/6.

My wife and I filed on 6/26. 341 meeting 08/13.

We recieved our letter from the court. No assets, no presumption of abuse. WAYYY under median.

Wow, where are you located? I didn't think you would see anything until the 341.

2manybills, you will get the notice of the 341 in the mail. that will have some info on it that's basically taken out of the petition you filed.

How can you say no presumtion of abuse?. Did you get that in teh letter?. or
did you check on PACER?. because I do not see that on my case search.

My 341 metting invitation says no presumtion of abuse. What does that mean?. The creditors are or trustee is not going to grill me?

bkfdrusa, it means that when your lawyer filled out the form/means test, it showed no presumption of abuse, which means that on its face, you qualify for ch7. that's basically your position. if the creditors or trustees have a different position, they will have to say or do something.

Racking J - Congrats to you too! I agree - I am excited to be underway and also nervous.

BK filings have increased 75% in So. Cal since January, so our court system is being flooded right now. I'm hoping to slide through but can't help trying to play out every possible scenario in my mind.

2manybills, everybody is thinking up worst-case scenarios, and in 99.9% of the cases they never happen. it's very hard to stop imagining the worst, but please keep reminding yourself that the odds are totally on your side. think positive!
