    Now can I finally file our income taxes?

    We have yet to file our taxes this year. Our lawyer had told us to wait. He said if we got the Ch 7 to go through then we could keep our refund. Can I file now or should I wait until we're discharged? Our refund will be around $1500.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

    Something is not adding up. The trustee's ability to get your tax refund has NOTHING to do with when you file your tax return.

    It might be an issue with the fact that your case is a conversion.

      If we had filed before the 7 went through then the trustee would have taken it. Now that the 7 has gone through my lawyer says it ours to keep. I'm just a little leary still.

        Aces, or whoever can answer.If one hasn't filed taxes this year(say one is getting a refund) how does that tie in with having to provide the last 2 years of tax returns when filing?

          We had to provide 2007 and 2006.

            some districts only require one year (in fact, the bk code requires only one year too).

            ace, i'd follow the lawyer's advice. he knows the trustee and the system, so listen to him. that's what you paid for!
