    Please verify for me that the income used to determine eligiblity for filing chapter 7 is your income for the 6 calendar months prior to filing? For example, if I filed in June 2009, the income used would be from Dec 2008 - May 2009?
    I think my atty. might be an idiot . . .

    Yes. You are correct. If you are unemployed for 2 or 3 months between Dec 2008 and May 2009 then take that into account.

      We filed in June they used from Dec. '08 to May '09.

        Yes you are correct!
        4/09 Converted to a Ch 7 due to loss in dh's income
        5/09 UST now involved no idea what happens next
        7/09 UST has decided to withdraw his motion to dismiss!
        7/27/09 DISCHARGED!!!
