I just wanted to share my experience...
I was financed through Nat City.... stopped making payments in July 08 per my Lawyer.
Discharged on 4-17-09 from my chapter 7 bk - truck was surrendered in the bk.
May 09 rolls around (last month). I called Nat City and told them Im sick of looking @ the truck and want it GONE. Ive called them several times before this trying to get them to come pick it up, or give me a place to drop it off to no avail.
The representative from Nat City goes "Sure thing sir. We will gladly come get it in the next 3-4 days. First, would you like to make an offer to keep the truck? We dont really want it back, it will probably only yield 2 or 3 thousand at auction and you owe 14 thousand on it"
I said "wwhaat? I surrendered it. Let me call my lawyer". Called the lawyer, they said make a lowball offer and that it was perfectly ok to do so, after I was discharged (and I was).
I owed $14,000 on the Envoy. Offered the bank $2,000. Guess who accepted the offer and guess who has a beautiful SUV with a new lien-less title?
Moral of the story - good things come to those who wait. It might take them a while to come and get it, or if you like the vehicle - post discharge - make a lowball offer to the bank. Its legal, and you might be surprised....Retained bk7 laywer 8-12-08, Filed 12-22, 341 Meeting Scheduled 1-29-09
Discharged 4-17-09!!!
Reason for filing: Medical, NOT irresponsibility with credit.
