    Question Regarding Secured debt and garnishment

    Long story short....I purchased a 4 wheeler about 5 years ago then fell into some trouble and quit paying on it. The bill has since went from collection to collection until someone finally got a judgement on me and has just started to Garnish my wages. I have a consultation for bankruptcy on Tuesday and am looking at filing Chapter 7.

    The problem is that I no longer have the 4 Wheeler. It was wrecked a Couple of years ago...eventually dismantled and never fixed. essentialy there is nothing left of it.

    I know my attorney will tell me the best course of action but thats on tuesday, and i am curious now. The whole time it was in collections no one ever tried to repo it and its listed on all 3 credit bureaus under account type as revolving account....not secured account.

    What will happen? will I have to reaffirm this, or will they come after personal property, or will it get wiped clean? The amount is $4800 but that includes fees from the office that got the judgement. Thanks in advance.

    if you don't have the car, there will be nothing to repossess, so it really doesn't matter whether it was ever secured by the car or not.

    but, $4800 seems like a small amount to file bk on. perhaps you could come to some payment plan with this creditor instead of filing bk? bk should be the last resort.

      4800 is just one of the many debts owed. Everything else is unsecured credit card debt.

        Do you have a copy of the original agreement when you purchased the four wheeler?
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
