Question in regards to 341 and new job...

    What about before

    On 09/06/05, I started a new job (before we filed on 10/12/05). This job does pay more, however, I do have to pay a lot more for my medical and dental benifits. My income has gone up $7500.00/year, but I will be paying $5520/year for my benifits ($460/month........they are the best benefits I've ever seen!!!!!)........so...........in reality, my income has only increased by $1980.00/year.....and considering we were about $800.00 in the negative every month, I would think my atty. would have mentioned or suggested Ch.13 instead of Ch.7, right?

    We had retained our atty. in August and we had already started the BK process. During the period of finalizing our docs., I listed my new employer, income and my first pay-stub. Our atty. called to question this and when I explained the large contribution to medical and dental benifits, he had asked for me to send a copy of the medical and dental plans for the records.

    I should be okay, right? Afterall, look how far in the negative I was. Obviously, the extra $165.00/month ($1980.00/year) isn't emough to cover the negative. This kind of has me worried.

    Discharged - 02/16/2006
    Case Closed - 11/08/2007

      Still in the red...

      If your outgo exceeds your income, then
      your upkeep becomes your downfall!


      BassBoy -- if you're still in the RED --- as far as income vs. expenses AND assets vs. liabilities --- you should be OK for ch. 7 it would seem... as far as the BK trustee and the US trustee would be concerned.

      11/17/05: 341 meeting (done!)

        Well, I had my 341 meeting yesterday and all went well. I was worried that having a new job would threaten my chapter 7 bk. The trustee never even asked me wether I had a new job, so in the end, all the worry was for not. He proclaimed at the hearing that he would post my bk as a no asset distribution and wished me luck, he was a nice guy!

        09/20/2005 Purchased Form7 software and started listing debts
        09/27/2005 About 80% done with the paperwork. Goal is to file next week on 10/03/05
        10/03/2005 Filed chapter 7 bankruptcy with the western district in washington state!
        10/10/2005 Received notification in the mail that my 341 is scheduled for 11/09/2005 with instructions to bring SS Card and ID
        11/09/2005 Successful 341! Trustee proclaims NO ASSET DISTRIBUTION!!! OH YEAH!

          Congratzz, craigerzz!!

          Lucky you did not have my trustee, she seems to always ask "do you still have the same employer" as one of her standard questions!
