    Health Savings Account and Bankruptcy

    Will our HSA be seen as an asset? Will they take that? We have insurance with a very high deductible and need the HSA as we have two kids with health issues and we have about 2-300 dollars a month medical expenses in addition to 500 dollars a month for insurance.

    Ours was included as an additional medical expense. No one's even mentioned it. We put aside $250/month. -- Edited to add we are in a Chapter 13, but I would still think the HSA would be looked at as a monthly expense.

      I beilve it is exempted, but that depends on what state you live in.

        Anyone know where to find how much you are allowed to contribute and how long before the filing it has to be? I don't know if we should quit contributing for a few months or what.

          You can 'Google' HSA & Bankruptcy and add your State on the end. If you are unable to determine if it is an Asset or Exempted by using 'Google' and don't care about posting the State you live in, Listed here.

          I'm sure there will be someone who will be able to answer your question. Just my thoughts on your situation.
