    GMAC just called again

They want to set up the surrender of dh's truck. I don't want a repo man showing up here so I told the guy just tell me where to take it to and I'll deliver it. He's like no we don't do that you'll have to work that out with the repo company that we assign it to. Sigh. Now I'm stressing. I don't want a repo guy showing up at my door.

I have a friend that wants to buy it but he only has $6500 cash. So I ask the guy how much is pay off on it? He says $9700. I said well how much would it take to pay it off and keep it? He put me on hold and comes back and says $6500 cash and it would be a done deal.

I just emailed my attorney to see what he says. If it works out my friend may buy it otherwise I have to hope the repo guy doesn't show up here.

Edited to add: Why is that they need to pay extra to get a repo man involved when I'm willing to voluntary bring it to them? That part didn't make sense to me.

Hi - I just voluntarily surrendered my leased vehicle last night. TMCC did the same. Even though I was voluntarily surrendering it. So I told them that we moved the car (because I didn't want my neighbors seeing a tow truck taking the car away). My husband and I met the guy at my MIL's house and actually he was so nice. He told me that so many people are voluntarily surrendering their leased cars - that's all he does. I didn't know what to expect so I was pleasantly surprised. It worked just say we moved it and then we met the guy somewhere else.

    You might try that.

That's what I hope to do. I'm going to take it to my mom's house. I hope it goes smoothly.

Good luck to you. Just tell them you've moved the car for safety reasons. Be sure to take everything out. This guy even told us take out the old registration, you just never know who gets the car when it goes to auction.

I hope yours goes as smoothly as ours did.

I took my GMAC lease back to the dealer that I purchased it from and then called GMAC up the next morning and told them that I dropped it off there last night. The dealer was closed and I left it in the service area. I did write down the VIN # and took the plates off. GMAC had absolutely no problem with us doing that. I too didn't want the REPO guy to show up at my house.

          Goodluck.

I am not sure about your state but under some states laws like ours the lender cannot pick the car up. They must get someone else.
But nothing could stop you from taking it to a GM dealer and leaving it there for them to pick up if you don't want them at your door.

Thank you so much for this post. I asked the same question in another post and got a bunch of conjecture from people who hadn't surrendered their car.

I'm going to surrender mine tomorrow. I like this idea of just giving them a random location (definitely NOT my MILs...LOL!)

Good luck. They didn't give me my license plates back like I've seen some people say. I did have him sign a little hand type document that acknowledged receipt of the vehicle with the VIN number on it and had him mark the miles down on that sheet too. I also put my loan number on it too.

I guess I've been in the legal field for too long and didn't just want to turn over my car without something in writing so I could cancel the insurance on the car.

I took my motor home to B of A and parked it in their lot. I could not afford to pay for it and my loan was current but we knew what we had to do.
They did not want it, I gave them no choice.
They had me talk to someone in their RV finance department somewhere and she was rude and told me I could not do that.
I told her I was not asking for an opinion just telling this bank what the facts were.
I hung up, put the keys on the desk, went home and canceled the insurance the same day over the internet.

You should remove the license tag when you surrender. I did as the posters did above, took my vehicle to another location and had the bank/creditor pick it up from there. It was the best way, IMO.

That "conjecture" seems to coincide with the non-conjecture you found in this thread. Perhaps you should also revisit that thread and thank the conjecturers for conjecturing sound advice.
Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

If you revisit the thread you'll see I did thank everybody there, including you, several days ago. This thread was more helpful to me, as it was based on personal experiences. But sincerely - there's no need to pick on me - Thanks again!

You have to remember that the repo guy is praying that YOU are cool. He would rather treat the whole ordeal like he's picking the car up to go to the repair shop.

But voluntary is usually the best for all involved. The creditor doesn't have to pay a tow, you don't have the tow truck come over, and you get to surrender it on your terms more.
I do not provide legal advice. All I do here is give my two cents as an opinion and at least share some of the facts that I know. Attorneys can provide legal advice, so go ask them or hire one.

Not picking on you. Just making a point. Let me make it another way. Are you relying on an attorney to file BK for you? Has he/she ever filed for you before? If not, why would you rely on his conjecture? He's merely speculating on how your results may be.

If you got the same information from both threads how could one have been more helpful than the other?

I'm off to revisit the other thread! Have a great weekend!
