    Do balances matter on your petition?

    I rec'd a pymt stmt from HFC Sat in the mail. Not sure why because we've been filed since Apr 30. So I checked our petition to double make sure that they were listed, which they were. But then I noticed that the atty must have mixed up a couple of the balances as we have 2 HFC loans. On 1 he put the total amount due off one of the stmts as the balances and the 2nd he put the balance of the 1st HFC loan. Does this matter and does it need to be corrected?

    I asked that same question of my atty since from the time I filed the interest and late charges sky rocketed on all my accts. changing the balances. My atty said it was not an issue as long as he had all creditors listed and 6 months of statements brought in.

      i agree with 2live

      the company's bankruptcy department probably hasn't yet processed the fact that you filed for bk. that's why you still get statements. if they send you yet another one next month, it may be time to complain.

        LOL well you'd think they would have by now since we filed nearly 2 months ago. We also got a letter from our mtg lender yesterday in the mail dated 6/17 requesting updated paystubs for a loan mod we were trying for before we filed and i know that they are well aware of the bk as their hearing to lift the stay is today...

          Hehe, I get letters from my mortgage company that say the following:

          "This is an attempt to collect debt bla bla bla... If you have filed for bankruptcy, then this is not an attempt to collect debt..."

          LOL...lemme see if I can pull up the exact wording.

            The only time balances matter is if you in a chapter 13 and are pushing the debt limitations ($330K Unsecured, or 1.01MM for secured). Otherwise, your best guess or last known balance is sufficient.
