    Notice of Appearance?

    OK, so I'm compulsively checking pacer and I see a new document has been listed. It is listed as "Notice of Appearance Request for Notice" so I immediately go into panic mode because it is from American Express.
    So I click on the document and this is what it says.
    Request of Creditor Pursuant to Bankruptcy Rule 2002(g)
    Providing Address For Services of Notices
    To the clerk:
    1. This request is filed pursuant to Bankruptcy Rule 2002 (g) for the purpose of ensuring that the creditor listed below receives all notices required to be mailed under Bankruptcy Rule 2002 at the address below.
    2. The address to which all such notices should be sent and substituted for that of the creditor:
    American Express
    and then the address
    Then it lists Amex's atty info


    The QUESTION I am freaking out about is, why does it say Notice of Appearance? The document doesn't mention anything about appearance, just changing the address. Does this mean that Amex is planning on showing up even though they don't say so?

    All of the accounts listed in the BK have to receive notice of you filing BK. They have the opporunity to appear at your 341 meeting but most don't attend.

      Many creditor attorneys file a notice of appearnce just so that they receive notification. When you file your bankruptcy, you use the address of the creditor. However, the creditor attorney may be at a different address (more than likely). So, this is how they (the attorney) stays notified of the proceedings.

        So, 'Notice of Appearance' doesn't necessarily mean that they plan on showing up.

        I think that I would just die if American Express showed up to question me.
        Seriously. I don't think my nerves could take it.

          no, the word "appearance" just means representation by an attorney. saying that an attorney "appears" on behalf of the creditor, or files an "appearance," is just another way of saying the attorney represents the creditor in the case. it does not mean they will appear for a hearing. it's legalese for representation. in fact, an attorney technically cannot file anything in court without first saying who they "appear" for.

          so bottom line: don't worry about it, it means nothing other than that the attorney wants to be notified, as justbroke said

            Everytime I'm in court and am called to come forward be heard.... I have to enter my appearance as pro se.
