    Reaffirmation important question

    We have 50k owed to B of A for unsecured credit it was recently charged off and sent to a collection agency

    Our home loan just merged from country wide to B of A ( we have NEVER been late)

    If we file a chapter 7, and the home division of B of A sees that we are looking to discharge 50k of B of A unsecured debt is it an automatic strike that they won't allow us to keep our home by reaffirmation?

    Trying to decide between a 13 or a 7

    It is more than likely BOA would be more willing to allow you to just reaffirm the home and let the credit cards go than if you were dealing with a CU.

      Bank of America is not a credit union (CU), so those things you read aboutCU cross-collateralization and such don't apply. So, as JR writes, you shouldn't have any issues at all with reaffirming the mortgage.
