Hi folks, I have a question here. My wife filed for a chapter 7 in a community property state, AZ. I filed previously in 2001 and am prohibited from filing with her joint at this time. Here's the gig. All of our creditors have been reporting correctly except CHASE auto finance. They have reported to my wife's report as included in chap 7 filing. They have reported to my report as "delinquent, 30 & 60 days." I have contacted them and told them to remove this reporting since it is in violation of an automatic stay. They are also advised that the car in question is being returned through the process. I am working on trading in the car and our other car for a single car (I already own a used car outright). Since CHASE does not want to play nice, they destroyed my credit and thus I cannot trade the car they have the loan on - thus paying it off in full. If it is returned, they will get a lot less through an auction with NO hope of getting the deficiency balance since it's a community property state. you would think they would see it my way and get paid off this week, but they would rather play hardball and violate and automatic stay - including willful negative reporting.
What do you guys think of this one??? Do I even have a chance at getting this removed from my credit report as shown "delinquent" since she is not yet discharged? My attorney has yet to call me back on this one, but Chases's attorney here in town seems to think they can keep on going with the reporting.
