    Vehicle loan frozen after chapter 7

    We filed Wednesday, chapter 7. I went online today to pay my truck note and my account was frozen. So I called the customer service number, entered my account number, and the automated voice says, that account has been transferred to our bankruptcy department. When I finally got to a person, she said that I won't be able to use the online system until after discharge.

    Here's the funny part, I'm freaking out on the phone because the payment is due today and I don't want it to be late. So then I realize how ridiculous that is and I explain to her, I'm sorry, I've never been late on my truck payment and I don't want to pay it late today, I know I filed bankruptcy two days ago, but I still don't want my truck note to be paid late!

    Sigh. Oh well, I guess I have to relearn how to write out a check and put a stamp on an envelope.

    It is normal sad to say .

    If its local you could just run by and pay it, otherwise like you say you'll have to mail it.

      I just use online banking and have my bank do it. I assume that will continue to work for me going forward.

        Yes normally you would keep online banking so long as you aren't defaulting any debt with that bank.

          most lenders are able to take a payment via western union quick collect. call them back and see if you can send the payment that way, it should post immediately.

            It it's a vehicle loan, you will more than likely recv a re-affirmation agreement from the lender through your atty. In the meantime, it's laughable that they would make it hard to accept voluntary payments through the period of automatic stay. This will not hurt you, and they cannot report it negatively on your credit. So, if they make it hard, don't make the payments until you hear from the lender in writing for a re-affirm.

              I had the same thing happen with my Wells Fargo Home mortgage. When I wasn't able to pay online, they allowed me to pay over the phone with an operator and waived the fees even. My bk isn't discharged yet, but I am now able to pay online again. Go figure...

                  It's against the law. It's a form of contact with you that they are supposed to stop in accordance with the stay.
                  I signed paperwork to reaffirm my Toyota before the 341 and they still stopped my online access.
                  They also told me that the minute that I was discharged my account would be accessible to me again.

                    Huh?!? I just went through this with Wells Fargo, I have a checking and a savings account with them, along with my Home Mortgage. When I went to pay it online with Bill Pay, it wouldn't let me. Called the CS number and was told I could NO LONGER pay the mortgage at the bank or online, I had to send it via mail at least 7-10 before the due date! The rep also said that I could pay it over the phone, but there would be a $20 charge! Did you ask for the fee to be waived, or did they offer? Hmmmm....

                      I don't have a checking or savings with them, mortgage only. I tried to pay online right after filing and it told me that the transaction wasn't allowed and to call a number that was listed. When I called, it was the bankruptcy dept. I asked about not being able to pay online and she told me that it was b/c the house was listed in the bk. SHE OFFERED to take the payment over the phone and SHE OFFERED to waive the fees! I didn't even suggest it. She also told me that I wouldn't be able to pay online until the bk was discharged. For some reason I went ahead and tried to pay it online the next month and it went right through. I really don't know why but I was thankful.

                        Same thing happened to me too..however, I sent my payment via billpay from my checking account. They are not allowed to collect debt while you are in BK process, so that's why you can't access your account online. Once your BK is discharged, you will be able to access online.

                        Make sure you call them if you do not start receiving statements after the BK is discharged..you want the loan moved out of the BK dept so it will start reporting onn time payments on your credit again. My car company didn't do that and I had to call them

                          Odd. We filed in April and I've been able to pay my Wells Fargo mortgage for both May and June using their online billpay and my non wells fargo checking acct. Maybe I ought to go back and make sure they were indeed deducted from my balance....not that it matters, I s'pose...we'll likely end up walking away from the house in another year anyway. As for the car not....we have 2 auto loans through GMAC. One we're surrenduring and one we're hoping to ride thru. They've blocked us out, so I have to mail a check to them now. I was lucky enough to notice we'd been blocked in plenty of time to mail my payment in.

                            This is very interesting reading for me, I was wondering why Sallie Mae cut off my online account access and will not allow me to make online payments (which I have always done and intended to continue during my BK). Now I know!

                              Yes it sucks. My vehicle is the same way and I hate it. I like paying my bills online. I don't have bill pay through my bank b/c it costs extra. It's free to pay all my bills online except my mortgage company and auto loan won't let me anymore

                              5/09 UST now involved no idea what happens next
                              7/09 UST has decided to withdraw his motion to dismiss!
                              7/27/09 DISCHARGED!!!
