    DMI amounts?

    Wondering what everyones DMI amounts were when filing......how much and did it stay a 7 or make you get pushed into a 13....

    341 Scheduled July 9th, 2009
    60 day club memeber and counting.......
    Last day for Objections Sept 10,2009...

    My DMI is (-neg) $132 and I just filed with over the median income. My attorney doesn't see a problem...
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      Did your means test give you that figure or was it your Sched I - Sched J? Please let me know, thanks.

        Both the means test and my schedules gave me a neg. number. All my expenses are pretty standand, but I have a few that are excessive but can prove with receipts.
        May 2008 Hired 1st Attorney/Stopped paying CCs
        May 21, 2009 Retained 2nd Attorney
        May 28th - Filed for Ch 7 (FINALLY!)
        9/11/09 - DISCHARGED!!!!

          There is a formula...if your DMI x 60 is below $6500 then you can file 7..if it is ovre 10,900 then you are pushed into a 13. If it is between 6500 and 10900 then there is another formula..if DMI x 60 is less than 25% of unsecured debt the you can file 7, if it is at or more...then you are pushed into a 13.

            I hear it's best to have a DMI that is negative on your schedule J (to give wiggling room). From posts on this forum, any DMI over 160 will likely make you a good candidate for 13. My DMI was -124.

              That is a question I have wondered too. My DMI is -103. My attorney wanted to have "wiggling room" like Frshstart09 stated. I really do not want to be forced into a 13. I feel like we struggle without paying creditors and want to "start fresh" as much as possible.

                Like "ska" and "frshstart09", my attorney wanted me to be in the -neg #, but not too high of a negative number. I was a little concerned because what if the Trustee goes over my expenses with a fine-tooth comb and "throws" something out my schedules, that would immediately put me in the positive and push me into a ch 13 (if over $160). My originally speadsheet showed $-459 , but my attorney threw somethings out and he said it was better to have a petition "not stand out" from the others, therefore we went with the -$132.
