    We were discharged last July and we haven't

    received our stimulus payment which we are supposed to turn over to the trustee. The IRS is giving us the run around with this saying it was mailed, although we did NOT receive it! If it takes forever for our BK to be closed due to this, will it hurt us in any way or is the discharge date the only date that matters? Thanks...

    Did you owe any back income taxes? If so, it is probable that your stimulus check was applied to that debt, though you should have gotten a statement indicating that it was. This happened with DH and I.

    If you used an attorney to fie, I would check with him/her about the stimulus check.

    For the most part, the Discharge Order is the one that matters. Closing means that all the administrative details going on in the background have been finished.

    That makes me think of another question: Were you an Asset Case? If so, that seems to take longer to close as well because of the administrative details. 'Hub and I were Discharged on Aug. 13, 2008, and we are still waiting for Closing. We called our caseworker at the BK court the other day and was told that we were waiting for the Trustee and his attorney to finish up the loose ends and not to be concerned.

      We filed pro se and we were an asset case (even without the stimulus being included). No back taxes or any other federal debt was owed.
