I am planning on filing CH 7 at the first of August 09. I have a about $25K of unsecured debt with BofA. I also have a truck that is financed with BofA that I am upside down on by about $3K. When I file Ch 7 (no asset case) do you think they will take the truck out of spite. It would make no sense for them to due to the fact that I owe more than it is worth and I am current on payment at the time of filing. What do you all think?

CC and Car loan with BofA

My BK7 was discharged in July 2009. I also stuck BOA with large CC debt and had a never late upside down car loan with BOA. I never reafirmed the car loan and have continued to make on time payments. BOA continues to send me my monthly car loan stmt and I always pay at the local BOA bank. So, odds are that BOA will not try to take your car as long as you are current.

Well, I can't say I have never been late, but I am current. And after BK should be able to be on time every month and possibly be able to pay more than my basic payment.Filed 9/01/2009
