    Help!!

    We are finally filing this week and when I was reviewing the petition - on the B22 for last payments to secured .. I saw the mortgage and1st and 2nd was listed with payments x the last three months when acutally I havn't been able to pay the mortgage in april/may and i miss one payment on the 2nd
    so i emailed the correction and the preparer wrote back that she would delete the payments for both loans since they didn't add up to at least 600for the 90day period

    I wrote back asking if i would still qualify if we deleted those mortgages and she said No

    GASP!!!

    But I thought I would still qualify on means because it is a contractual amount due (from reading posts)

    wait I just got clarification.. we are not deleting the "mortgages" we are just correcting the payments on the statement of financial affairs... should still be ok to file
    I am really hoping the mortgage company will work with me on a loan modification, i have never been late before the last 4 months
    I don't want to reaffirm though.. that would be a bad business decision.. right now the house which appriaised last year for 340,00.00 is now valued at 130,000.00 .. I owe 230

      If you reaffirm it will be on that very agreement. They won't forgive an amount and then do a new loan moving forward for an abbreviated amount.

      If you don't like the underwater-ness of the house and this house isn't EVERYTHING YOU DREAMED IT COULD BE, then it may not be the thing to keep. If you are 100% satisfied with the home that you have, then maybe its worth keeping. It's all about your intrinsic value you place on your home. If you could be just as content surrounded by four different walls and a different roof, then that's something to consider.
