Todays the day! My 341 is scheduled for 1:15 this afternoon. I'm trying not to be nervous. I was doing good until I checked pacer this morning & noticed a relief of stay was filed for my car. We put reaffirm on the paperwork hoping to work out a deal but looks like they don't want to deal. I just don't want to get put in a 13 now. Nothing I can do for now. I'll let you know how it goes-wish me luck!

It's over
My 341 went well I was so nervous but he just asked the standard questions & it lasted about 3 minutes. The worst part was sitting around waiting for my turn. There were a few pro se filers there & one was so disorganized she didn't have the forms filled out properly. I thought, obviously she hasn't found bk forum yet or she would know that.
I'm not completely relaxed yet, I'll feel better when the 10 days have past for the UST to object (or whatever they call it).
Glad to be in part of the 60 day club

I had my 341 today too. It took 2 minutes. People ahead of me had problems with paperwork and spouses income not being reported and incomplete paperwork by the attorneys which pissed off the trustee.
They asked me for my Identification, address, if I received bankruptcy forms, did i read the paperwork before i signed it. am i surrendering house? I told them i was planning on keeping it and he said why. I explained and he said have a nice day. Make sure your paperwork is correctly done by your attorney and tell your attorney about your situation.Retained attorney 4/21/2009 Monday

He didn't even ask about the car or address the relief of stay. My attorney thought that was a good sign. My attorney has until 6/24 to answer the motion. I would like to just surrender it since I'm so under water & a big payment but without the monthly payment I have $200 disposible according to the schedules. I'm afraid if I don't reaffirm I'll get switched to a 13.
It's financed with hyundai & my attorney said when she called to negotiate with them they said they don't negoiate the only options are pay past due amount plus attorney fee & court costs or they will repo it. If I wasn't worried about a 13, I would tell them to come & get it!

I had my 341 today too! Maybe we'll be discharged on the same day as well ;o)
I'm in a similar situation. I stated I would retain both vehicles because without those payments I would have too much disposable income. I have not yet spoken with either lender. However, you cannot be FORCED to reaffirm a debt. My attorney told me that he does not know of one case where a debtor wanted to keep a vehicle, but failed to do so (either through a failed reaffirmation agreement or inability to get current), but then was penalized by being converted to a 13. I'm waiting to see if I can ride through with my loans if possible. I would wait to the last minute and refuse to sign any reaffirmation agreement. Of course, I would ask your attorney of the possible consequences. My attorney says I can walk away from both if I cannot come to an agreement with the lender. We'll see.
