New job AFTER filing before 341 though

    New job AFTER filing before 341 though

    I got a job offer that I have to take for future security. It is not more money than I am making now. Actually it is a little less. Do I tell my lawyer? What is the importance of this information? I plan on telling my lawyer of course but I was just curious as to the implications of me taking this new job....

    if you're filing chapter 7, it shouldn't matter. they are supposed to care only about what the situation was on the day you filed.

    even if it did matter, what would be the difference? you are now making less than before, so if you couldn't pay your creditors before, you certainly can't now, right?

      even still......I would be making less money....Should I tell my lawyer? Do the trustees verify jobs? I thought at the 341 meeting they ask for place of employment or address of place of employment....I dont start the new job till June 22 just really confused on what to do.....anyone??

        go ahead and tell your lawyer. it will make you feel better. and i bet he or she will tell you that it won't matter. if he/she says otherwise, let us know!

          I told my lawyer that I "MAY" have a new job opportunity and what to do about it and he said "dont tell him about it", and that the only way it may come up is at the 341 meeting when the TT asks if "you forsee your income going up or down in the next year by more than 10%" the answer is "no".....

          Plain and simple......

            It is that plain and simple. If the offer were for more money, then that would be an issue. Less money - not an issue at all. It's all about the money - not the employment.

              Changing Jobs

              I have the opposite problem. A better job between those two dates.

              When they ask you if you project any forseeable changes in your income, they're trying to see if you will have the means to pay in the near future even though you couldn't pay currently.
              Then they can deny you your petition. If you'll make LESS, it helps you to look even more qualified than you are now to file bankruptcy. This would be totally different for chapter 13 but you said you're in chapter 7.

              I'm just an average person, not a lawyer, but I'd be hesitant to withhold something from the court ESPECIALLY if it's something in my favor! The next 6 months after this, the court states that they keep tabs on you. Whether they actually do or not, I don't know.

                I mentioned it to my lawyer again, I start the new job June 22 and 341 is July 9th. I told him I may have an opportunity that will be no more money than I am making now what should I do? He said again, dont tell him about it.....This is driving me nuts......I hate having to make these decisions.....I don't want to hold anythin gup and at the 341 if they ask me "do you foresee making more money in the future" I can honestly answer NO.....I hate this

                  i think what your lawyer is trying to tell you is that you don't need to tell the trustee about it because it just doesn't matter. it's immaterial. if the trustee asks whether anything changed, even though the question sounds very general, it really isn't. just like you wouldn't have to "reveal" that you got a haircut between the time you filed and the 341 meeting, you also don't have to reveal that you changed to a job where you earn less. however, if you get some inheritance suddenly, that you would have to reveal. changing a job to one that pays less is not something relevant to the trustee.

                  it's something like somebody asking you "how are you?". well, do you have to tell them absolutely everything? no. is it a lie if you don't? no.

                    I'm in missouri and my husband has a job offer that he just accepted that begins after the 341 meeting...and our lawyer said it was fine and to just say no at the 341 meeting..even though this job will increase his income substantially. She has never said they keep tabs on you for six months after the fact...in fact she said that at it's possible, but unlikely, that the trustee will be curious about our income for the month leading into the 341...and that was why she advised him to wait to start till after the meeting...

                    Now I'm confused....I'd like to think I can trust what my lawyer has to say...

                      With the income going UP that would be scarey. Mine on the other hand will basically stay the same if not go down a few dollars, but my attorney said the same thing. If they ask, say "no". Once again, I hate this...
