    Those who included student loans in means test...

    I've read that some people have included their student loans in their means tests, while others have not. For those of you who did and were successful, where did you put the student loans on your means test? Some of you said you did include them. Where on the test did you do that? Also, what state are you in? THANKS!

          The first one was promising, but the second one, not so much. Because of our student loan debt, we are over the max for a ch 13. We really are in a bind if the court does not allow the student loan payments for special circumstances. Ugh!

            They rarely deny forbearance payments...

              What do you mean by "forbearance payments." You mean the SL companies rarely deny a forbearance or the BK Trustees rarely deny SL payments in the means test?

                The student loan companies rarely deny a forbearance request by an individual. Like, you call and say "I can only pay $30 a month...", they usually say "okay".

                  Oh, yah, I get it. We're thinking seriously about not doing bk and just trying to pay them off one by one. It's all very overwhelming...

                    All of the SL companies I have loans with right now are denying my forbearance requests. And have been for over a year. And I am in school as well. They said I have maxed out my deferrent and forberance time and are not offering any more. A year of going back and forth, and nothing....

                    I did include my SLs on my means test, but at the end as a special circumstance. We'll see. My 341 is 6/22. I am in Central CA court.

                      Teacher, if you could some how refinance those loans with Sallie Mae, the forebarance period on those loans will start over again. I had almost exhausted mine at one time then refinanced it and then it started over again at 60 months.

                      Not sure if that helps or if you are able to, but just wanted to throw it out there for you.

                        I am also in Central California (Fresno), so I will be waiting to hear what happens with your meeting. If it works for you, I may give it a try myself. Are you filing on your own or with a lawyer? Thank you so much for sharing that....it gives me a little hope!
