    What if a creditor doesn't receive notification?

    Hey Folks:

    I am concerned that a creditor (US Bank) may not have received notification of my BK filing, because they are still showing my credit card account as open, and because there is no notation associated with this account in my credit report indicating that it is included in the BK filing. The address I used on the creditor matrix was for cardmember service for account problems or inquiries, as shown on the back of the monthly statements. Should I do anything? I don't like the idea of potentially rocking the boat since the whole process has been very smooth so far and I expect to be discharged on July 20. But what happens if I am discharged and US Bank later claims that they were never properly notified?

    Any thoughts or similar experiences would be much appreciated. Many thanks in advance!

    Mail them a copy of your first page of petition, CRRR, but if you didn't get anything back from the court, they probably received it.

    They are probably on the e notification list anyway, look at your paperwork from the court, it will probably say who was notified electronically.

    They are a big bank, they probably part of the E noticing system, just slow to update CR.

      Your credit report does not necessarily update every little detail. If you provided a good address for the original creditor, you should be okay.

      These accounts are sold and resold all the time. You are NOT expected to keep up with all the changes.

        You do not have a problem. Keep the copy of the address you put on the Matrix. It is not your problem if they are too big to talk to another department. They will also be discharged. You did your part. 'Hub

          I have the same exact issue. They keep sending me a statement every month, and it still shows as open on their website, etc. I called and confirmed they knew the BK several times. I sent a letter w/copy of the discharge/filing telling them to piss off. If I get more junk mail from them I'm researching sanctions. It's really annoying.

            Don't worry about the credit report yet it can take 2 months to update there in some cases. Only worry if you still get a bill and then take it to your lawyer.
            May 31st, 2007: Petition Filed by my lawyer
            July 2nd, 2007: 341 Meeting Held
            September 4th, 2007: Discharged and Closed.

              Just make sure they DO SHOW on your petition that was filed. You can find that on PACER. I have had a few (just recently last week) tell me they never received notification and were going to go after my state tax refund- I proved to them they were on the petition - so nanananaboobooboo.

              They basically wanted a copy of the discharge and that was it.
