    Paying rent to a relative before filing, AND MORE

    I can post 100 topics that are so conflicting right off the top of my head.

    Heres one.
    I live back with my dad, and do a lot of stuff for him because he is a 100% disabled veteran.

    I sold a car so BK couldn't take it. I have to spend the money in a reasonable amount of time and on necessities only, LIKE RENT. One attorney said I have to use the money up and file after 6 months. He said pay rent, etc.
    Another attorney said I can file as soon as I use it up. Even if it's two months. And he said pay rent, etc too.


    Wouldn't paying my father rent be considered paying a relative? (I explained the situation I'm in, wasn't paying rent before)

    Just thought of another one. There are hurricane supply exemptions in FL. I could get some shutters and a generator, and file next week.

    Or could I?

    You know there are so many inconsistencies with this it's sickening.
    I don't even care anymore.

    I could blow a few thousand at a strip club, thats a necessity, I need to get my mind off this. How about a psychiatrist, I'm about to have a breakdown, I already take medication for anxiety.

    Wait I found another one. It says list all gifts in the past 12 months, do not list usual gifts to family members unless over $200....ok so I can blow the money buying everyone $190 gifts everyday until it's gone?

    LOL I loved your post.

    You can pay your Dad rent. In any form by labor (account for your time at a reasonable wage). It MUST be at least an equivalent to the normal area rent around where you live.

    Of course, medical problems such as extreme frustration, ergo, the strip club for mental health I can agree with you. Since you and I are both in FL, which one would you recommend? I need some mental relief myself.

        What are stip clubs? Do they cure mental health?

          great post, put a smile on my face, which should help delay or prevent my own breakdown

          rent is a necessity even if you pay it to your father. it is not paying back a debt to your father, so it's ok. just make sure the rent you report is reasonable for your area, i.e not way too high. you can check what is the average amount of rent by looking up the proper dollar amount for your area when you fill out the means test.

            Florida is unique in many ways with regards to your situation.

            Are you listed on the deed or mortgage? Not sure how it is determined who gains benefit of the homestead for legal purposes, but an attorney should be able to answer. If it is YOUR homestead as well as dad's you're in the clear.

            You could, at the last moment, spend a MILLION dollars on either purchasing or improving a homesteaded property, and not worry about creditors.

            One major test case involved a person named Potter. Google it to learn more, but the case was these folks moved a LOT of money to avoid creditors and pushed it all into their homestead.

            This went up the court line all the way to state supreme court.

            The ruling made it clear that, in Florida, you CAN do this and creditors cannot attempt to clawback or cry foul. Get that generator, or shutters, or anything at all that improves the homestead.

            Talk to an attorney first though!

              I guess they couldn't take back a new driveway huh? Roof? nope.
              Then again it's not my house in any legal way.

              Seriously I don't care, if I file and they don't discharge my case, screw it.

              What can happen if I get rid of all my assets?
              My car and my firearm for personal protection.
              What could they possibly take from me?

                  I'm pretty sure that if you go to one of those stip clubs, or however you spell it... there will be stipulations clearly posted or barked at you.
