    Do any of you know how to read the Trustee's REport?

    I'm having trouble. On 4-30-09 our case was converted to a Ch 7 from a 13. Everything has gone fine and all we are waiting on is the official 60 day discharge.

    In the meantime however they are still taking Ch 13 payments out of dh's check. I went to the trustee's website and it shows Close Pending-Converted to Ch 7 4/30/09.

    Okay then it shows for the money:

    Balance on Hand: 0
    Debtor Refund's: 0
    Delinquent Amount: $85.26

    The last payment he made to our creditors was on 5/27/09.

    When should these payments stop coming out? Even though we filed a 7 and that did help our bills out b/c we surrendered one of our vehicles we are still having a hard time financially at the moment I know it's only short term but still every little bit helps and I hate to see those payments coming out every 2 weeks.

    You and your lawyer may need to ask the Trustee to issue a memo asking the employer to stop the wage deductions. It will not stop automatically. You may need to prod the Trustee for this.

      So if the trustee keeps getting the payments is he allowed to keep them and pay our creditors with them?
      4/09 Converted to a Ch 7 due to loss in dh's income
      5/09 UST now involved no idea what happens next
      7/09 UST has decided to withdraw his motion to dismiss!
      7/27/09 DISCHARGED!!!

        No! Usually, by local rule, when a case is converted to Chapter 7, the Chapter 13 Trustee is to hand over all cash on hand to the Chapter 7 Trustee, immediately.

        Because Chapter 7 Trustees aren't use to "wage deduction orders", you may need to prod the Chapter 7 Trustee to stop the wage order!

          So maybe I might get that money back?

          I emailed my lawyer first thing this morning and attached a copy of dh's check stub. Hopefully they will work on this ASAP.

            I think the case was handed off to the ch 7 trustee, do you know who your new trustee is? I would definately get your attorney involved to stop the payments.

              The paralegal just sent me an email saying that she was trying to contact the trustee and would let me know. I do hope I can get the money back.

                Very good! Make sure you follow up in a day or two.
