    Chapter 7 and Foreclosure

    I recently received summons to foreclose our condo and when I went to talk to an attorney who's going to do the bankruptcy for me, he said that I don't need to answer the summons since I've decided to let it go. I just want to know if it is okay if I don't answer the summons? Please advise. Thank you.

    You do not have to answer if you plan to let it go.

    Bear in mind there are some expenses you will be responsible for until the deed is back in the lender's name.

      That's what my Attorney told me. Since the Property is in pre-foreclosure now, I just have to wait for the bank to do it's thing, so that I can include all "property related" liabilities into the BK filing i.e. HOA

      He said if I BK before FC, then I will be responsible for HOA up to deed transfer date, which can be a couple months due to the backlog in FC's in GA

      2009-Nov: 341 held
      2010-Jan: Discharged on Pacer
