    I'm am officially moving in...to this forum :D

    (darn! I can't delete the "am" part...opps!)

    Hi guys,

    As some of you know, I started this bk "journey" over a year ago thinking I was going to file a ch 13 because I was over the median by 20K (what I attorney told me I qualified for) and slowly paid his ch 13 fees (4K). Well, within that year, I found this wonderful forum and learned everything I could about BK. I realized that although I was over the median, my expenses outweighed my income, therefore putting me in a possible ch 7 category. As I learned more about BK, I started to doubt that my attorney was representing me correctly...well, he quit my case and I was back to square one I took my newfound BK knowledge and started interviewing attorneys again, most took one look at my above the median income and told me ch 13 only (without even wanting to hear about my expenses)...I knew better this time around, thanked them for their time and moved on to the next attorney.
    Well, I found a great attorney who knew what he was doing (shout out and thanks to Albacore ), hired him last week, and filed for a ch 7 on Friday! Finally!!!!

    I just wanted to say how important it is to find the right attorney, this BK process is stressful enough and you need an attorney that you are confident that is looking out for your best interests! It is soooo important to consult with at least 3-4 attorneys (I interview with 6) and not hire the 1st attorney you consult with (like I did the 1st time around ).

    My 341 is on June 29th and you know what? I'm not worried at all, what happens, will happen...

    Now, I'm not sure my petition for a ch 7 will "fly" by the Trustee and ultimately I may be pushed into a ch 13, but I know without a doubt, that at least both my attorney and myself did everything we could.

    Wonderful news, Liz! Ditto the shoutout to Albacore.

    I wonder if you could please PM me? I haven't hired an attorney yet, my case is a little complicated (to me anyway) and I'm afraid I'll get pushed into a 13. I briefly spoke with four attorneys but don't feel totally confident with any of them. I'm not far from the IE so I'd be really interested in meeting your lawyer.

          i'll be following your case, i'm right behind, just waiting for some income to fall off and let my debt age a bit. I found that guy by googleing BK att's in our area, and went to his web site . no bells and whistles, just straight forward info. a lot of it devoted to "proper planning" . after reading his site and reading what others have gone through here, I truly believe there should be no great rush to file. If you know your in trouble, admit it, start getting your affairs in order, then file when your ready. I think some Att's rush you so the can get their $$ quick. After all we live in America and people tend to want a quick buck instead of thinking long term.

                Most everyone in my area uses one of two of the local "bankruptcy mill" attorneys. They churn customers in and out the door so fast that there is no way in can be done right.

                The "good" bankruptcy attorneys in our area don't advertise that they do them. It is word of mouth. When you talk of the locals that spend all that money on advertising, they just snicker...

                  You aren't missing much here in the IE right now. We are experiencing unbelievable unemployment and foreclosures by the thousands. "This too shall pass" - I hope!

                      Aaah, Justbroke, you know you are always welcome to come "hang" at our Lucky 7 parties.

                      We are not judgemental. It was just a 13 was beyond our "means".

                      Or maybe you can host one at the rental that will never foreclose!

                        I may just have to convert to Chapter 7... so I won't feel like the 5th wheel.

                          Congrats Liz. I am in a similar situation. Almost 20K over median for a two person household. !st attorney said 13, second one said "probably 13, but let's run the numbers." Much to my surprise, I qualified for a 7. I agree with your sentiment about attorneys. You have to find one that truly will fight for you :o) Good luck!
