    Fee Dispute w/ Attorney----Opinions Needed

    CAN ANYONE CHIME IN HERE AND GIVE ME AN OPINION AS TO WHAT I MAY BE ABLE TO ARGUE. HE TOOK THE MONEY, DID NO WORK WITHIN A FEW WEEKS, AND I LEFT.

    LATER HE NEVER PROVIDED ANY ACCOUNTING FOR ANYTHING, NEVER PROVIDED PROOF OF ANY KIND OF SERVICES RENDERED. WILL NOT SPEAK TO ME REGARDING ANY SORT OF REFUND.

    tHE FEE OF 3000 WAS NEVER PAID IN FULL. I ASSUME THE AGREEMENT TAKES EFFECT ONCE THE 3000 IS PAID. THERE IS NO REASONABLE VALUE FOR SERVICES BEING THAT NONE WERE EVER RENDERED. THE ATTY CANT SHOW FOR ANYTHING.

      It does make me wonder what the hell we are paying these guys for. After all, their paralegals are basically filling out the forms anyway.

      I wish I knew about this cash cow back in college, so I could have pursued BK law. $3000 times 100 cases = $300,000. Not even 2 cases a week worth of work.

        call your state's bar assocation; that will help in getting your refund. Lawyers really don't want a complain against them...

          Thanks, I have complained with them, but he typed a letter a they accepted his side of the stor for some reason.

            Include him as a creditor for the remaining amount. Maybe they can get it back on the grounds of preferential payment.

              I wish...I have been discharged....not closed...but my bk size was more than 1.5 mill. Not enough for the trustee to bother with.

                it would depend on what he said to the bar association. what did he argue? generally, nobody gets paid for no services rendered. nothing is ever "earned upon payment." it's earned upon providing service.

                what does the retainer say about termination of representation?

                  Can you dispute the bar associations finding? I'm not sure how to do it but there might be a process.
                  May 31st, 2007: Petition Filed by my lawyer
                  July 2nd, 2007: 341 Meeting Held
                  September 4th, 2007: Discharged and Closed.

                    Sue him in small claims. They hate that. You may not succeed but it might make you feel good.
                    filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!
